1.2 PNEUS PIRELLI, a simplified joint-stock company (société par actions simplifiée), with a share capital of €1,515,858, having its registered office at Immeuble Rameau ZI Paris Nord 2, 22 avenue des Nations, 93420 Villepinte, and registered with the Bobigny Trade and Companies Register under number 301 768 867 (hereinafter referred to as “Pirelli”, “we” or “our”, as applicable), will act as the Data Controller of your Personal Data for the purposes detailed in Section 3.

2.1 We collect personal data which, in accordance with applicable data protection legislation, in particular Regulation (EU) 679/2016 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), includes information that can be used to identify you, including – without limitation – your first and last name, postal address, postal code, city, country, state, telephone number and email address (hereinafter “Personal Data”).

2.2 You may be asked to provide us with certain Personal Data about yourself by completing forms published on our website(s), and/or when you ask to be contacted, and/or during certain events, for the purposes detailed in Section 3. The Personal Data you provide may include your name, date and place of birth, email address and any other information you provide when you interact with us or contact us.


2.3 We may collect your name, contact details, email address, postal address and any other information you provide when interacting with us, conducting a search on our website, submitting a tyre registration form or contacting us.

2.4 When you browse our website(s), we may collect information that can be used to identify your computer and browser or any other mobile device you use to surf the internet. This information is collected by installing small text files called “Cookies” and other similar information technologies (collectively referred to as “Cookies” in this document). Among their other functions, when you revisit our website(s), previously installed Cookies allow us to recognise your browser. 3. USE OF PERSONAL DATA

3.1  We may use your Personal Data for the following purposes:

(i) to enable your registration on our website(s);

(iv) to allow you to participate in certain activities, events, initiatives or competitions.

The processing of your Personal Data for the purposes of this Section 3 is necessary in order to respond to your requests and therefore does not require your prior consent.

3.2  Pirelli may also use your Personal Data for marketing purposes, as described in Article 7 below, subject to your prior consent.

3.3  Providing your Personal Data is voluntary but necessary for the purposes of this Section 3; if you do not provide your Personal Data, we will be unable to carry out such activities.

4. SHARING OF PERSONAL DATA

4.1  We may share your Personal Data, where permitted by law, as follows:


(a) Pirelli Group Companies. Your Personal Data may be shared with Pirelli & C. S.p.A. and/or one of its subsidiaries established in Europe.


(b) Third parties (service providers, suppliers). f your Personal Data is provided for the purpose of participating in activities, events, initiatives or competitions, your Personal Data may also be processed by service providers and/or insurance companies appointed by Pirelli.
These third parties are subject to confidentiality agreements with us and other legal restrictions prohibiting them from using the information we provide for any purpose other than facilitating the specific operation in question, unless you have explicitly authorised or given prior consent for such additional uses. Unless otherwise indicated, they will act as Data Processors.


(c) Where permitted or required by law. From time to time, we may be required to disclose Personal Data in response to a valid court order, subpoena, government investigation or other legal requirements. We also reserve the right to report to law enforcement authorities any activity we believe, in good faith, to be unlawful or in violation of applicable laws. (d) Business transactions. If the sale is completed, we will require the receiving party to acknowledge that it is also bound by the provisions of this Privacy Policy and that it will use and disclose your Personal Data only in a manner consistent with this Privacy Policy. If the sale is not completed, we will require the potential purchaser not to use or disclose your Personal Data in any way and to delete it completely.

If you reside in the EU, in accordance with the GDPR, you have the right to access your data processed by us, to rectify it, to delete it, to restrict its processing, and you have the right to data portability, to be informed in the event of a data breach, as well as the right to provide instructions regarding the handling of your data after your death. You may also lodge a complaint with the competent authority in your country, in accordance with applicable data protection laws. We may not be able to fulfil all requests relating to certain information if we believe this would violate any law or other legal obligation or the rights of other data subjects. 6. RETENTION OF PERSONAL DATA

6.1 We will retain your Personal Data:

(i) for as long as your account remains active (if applicable);

(ii) for a period of 1 (one) year from our last contact if you have only requested information or assistance;

(iii) for the period required by applicable European laws for Personal Data collected for specific activities, events, initiatives or competitions;

(iv) for marketing purposes, for a period of 3 (three) years from the end of the last communication from Pirelli, unless you request otherwise.


We will also retain your Personal Data to comply with legal obligations, resolve disputes and enforce our rights (e.g. for defensive purposes). We will delete your Personal Data upon your request, in accordance with applicable data protection laws.



7. ELECTRONIC MARKETING COMMUNICATIONS

7.1 Pirelli and Pirelli Group Companies established in Europe will be the entities authorised to send you promotional emails (including newsletters) and other electronic marketing communications based on your specific consent to marketing activities.
You can always limit communications sent by Pirelli. To opt out of future marketing emails, simply click the “Unsubscribe” link at the bottom of each email you receive from Pirelli.



8. WHERE WE STORE YOUR PERSONAL DATA

8.1 Pirelli will store your Personal Data on its IT systems located within the European Union.



9. THIRD-PARTY PRIVACY POLICIES

9.1 This Privacy Policy applies only to the use and disclosure of information by Pirelli. We are not responsible for the privacy policies of other websites or applications, and we encourage you to review all applicable terms and privacy policies provided by any third party before providing them with your information.



10. NO INFORMATION FROM MINORS

10.1 If you are a minor, please do not provide us with any Personal Data without the permission or appropriate consent of your parent or legal guardian. If we learn that we have collected Personal Data from a minor without such consent, we will delete that information immediately.
