Terms and Conditions

1. Subject

1.1. These general terms and conditions of sale (hereinafter these “Terms and Conditions”) shall apply to the purchase, by users falling within the definition of “Buyer”, pursuant to the following section 1.2, through the website https://pzeroexperience.pirelli.com/en-us/ (hereinafter the “Site”) of a package named “P ZERO^TM Experience” (hereinafter the "P ZERO^TM Experience Package") or the gift voucher for the P ZERO^TM Experience (hereinafter the “Gift Voucher”) which will entitle the Buyer or the Voucher’s Beneficiary as the case may be (each as defined below) to participate, at the The Motor Enclave (hereinafter the "Circuit") to a day on track (hereinafter the “Event”) with Buyer‘s own or authorized third party car, ”), subject to such car being on the list of approved vehicles published on the Site (each, a “Car”).
The date available for the use of the P ZERO^TM Experience Package and the Gift Voucher (as applicable) and the relevant descriptions are published on the Site.
1.2. Each P ZERO^TM Experience Package and Gift Voucher is sold by Pirelli Tire LLC, with headquarters at 100 Pirelli Drive, Rome GA 30161 (hereinafter "PIRELLI").
The parties involved in the purchase of a P ZERO^TM Experience Package or Gift Voucher via the Site shall be PIRELLI, as seller (hereinafter the "Seller") and the party who purchases the P ZERO^TM Experience Package or Gift Voucher (as the case may be) for reasons other than in relation to the profession, business, trade or craft conducted by that party, as the buyer (hereinafter the "Consumer"), or in relation to the profession, business, trade or craft conducted by that party (hereinafter the "Merchant") as the buyers (the Consumer and the Merchant shall individually be referred to as the “Buyer” and jointly as the “Buyers”). The Seller and the Buyer, as the case may be, shall be referred to jointly as the "Parties". Pursuant to these Terms and Conditions, persons whose details are registered as Buyer, Additional Driver, Substitute Driver (if any) or Voucher’s Beneficiary (as the case may be) during the purchase procedure of a P ZERO^TM Experience Package and/or Gift Voucher, are the only persons who will be entitled to drive the Car at the Circuit.
1.3. Any communication by the Buyer, in connection with and/or in relation to the purchase of a P ZERO^TM Experience Package and/or a Gift Voucher, including, but not limited to, any notifications, claims or requests concerning the purchase and/or delivery of the P ZERO^TM Experience Package and/or Gift Voucher (as the case may be), etc., shall be made to the addresses and in accordance with the procedures indicated on the Site or to the email address pzeroexperience.usa@pirelli.com (hereinafter the "Customer Service").
1.4. All purchases are regulated by these Terms and Conditions published on the Site at the time the order is submitted by the Buyer.
1.5. If one or more sales are made to a Merchant, the following shall not apply to Merchant: a) terms and conditions that are in favor of the Consumer only;
b) provisions relating to disputes between the Seller and a Consumer.
1.6. In order to make purchases of one or more P ZERO^TM Experience Packages on the Site, Buyers must be aged 21 or older. In irder to purchase only a Gift Voucher on the Site, Buyers must be aged 18 or older provided that any Voucher’s Beneficiary must be aged 21 or older. In either case, a Buyer of the P ZERO^TM Experience Package or a Gift Voucher must have legal capacity.
1.7. The Buyer shall be responsible for any costs incurred to connect to the Site via the internet, including any costs incurred by the Buyer with their internet service provider.

2. P ZERO^TM Experience Package and Gift Voucher features and important rules for the access to the Circuit

2.1. Each P ZERO^TM Experiences Package and Gift Voucher is sold by the Seller with the features described and in accordance with the Terms and Conditions published on the Site at the time the order is sent by the Buyer, with the exclusion of any other terms or conditions.
2.2. The Seller reserves the right to amend all or part of these Terms and Conditions and any other terms published on the Site, at any moment in time, and in Seller‘s sole discretion without giving any notice to users of the Site. Any amendments shall become effective on the date on which they are published on the Site, but will only apply to orders placed from that date onwards.
2.3. Sales prices of the P ZERO^TM Experience Package sold on the Site and/or the characteristics of the same, are subject to change without notice and, therefore, the Seller does not assume any responsibility in the event of changes in the contents of the P ZERO^TM Experience Package and/or program variations. Such changes only apply to orders placed after the date of the contents change, provided that any changes to date or cancellation of the the P ZERO^TM Experience Package events are subject to section 8. In any case, the Buyer is advised to check the final purchase price, before submitting the order, pursuant to section 3 below.
2.4. Users from all over the world can access this Site; however, the P ZERO^TM Experience Package and Gift Voucher available on the Site can only be purchased by users who request the the P ZERO^TM Experience Package or Gift Voucher, as the case may be, for performance in the United States of America and otherwise met the requirements set forth in these Terms and Conditions and the P ZERO^TM Experience Regulations. During the purchase procedure of the P ZERO^TM Experience Package, the Buyer will have the choice to select one (1) additional driver (the “Additional Driver”), or the option to purchase a Gift Voucher selecting the P ZERO^TM Experience Package for a third party that is natural person (hereinafter the "Voucher’s Beneficiary”).
2.5. Access to the Circuit, following the purchase of a P ZERO^TM Experience Package or a Gift Voucher (as the case may be), will be allowed only to Buyer, Additional Driver, Substitute Driver and Voucher’s Beneficiary (as the case may be) who (each of whom complies with and represents that) (i) are the legitimate owners or possessors of the Cars and (ii) are aged 21 or older and have a valid driving license, issued for at least 36 (months) months prior to the relevant P ZERO^TM Experience event and not subject to suspension or other sanctioning measures.
Access to the Circuit will not be allowed to people other than the Buyer, Additional Driver, Substiture Driver or Voucher’s Beneficiary (as applicable) or to car(s) other than the Car(s) using the Cars identified in their Order registration on the Site.
Companions will be entitled to attend the Event, according to the P ZERO^TM Experience Regulations.
2.6. The access to the Circuit by each Buyer, Additional Driver or Voucher’s Beneficiary (as applicable) is subject to the prior reading and acceptance, signature and delivery to Seller by the Buyer, Additional Driver and/or Voucher’s Beneficiary (as applicable) of:

• (i) the P ZERO^TM Experience Regulations, which can be seen here
• (ii) waiver and releases which can be seen here or provided at the Circuit;

3. P ZERO^TM Experience Package and Gift Voucher purchase procedure – Conclusion of each individual purchase contract

3.1. Each order submitted by the Buyer to the Seller via the Site has the value of a contractual proposal and is subject to these Terms and Conditions which form an integral part of the purchase order and which the Buyer, by placing the order, fully accepts without any reservation. Before proceeding with the purchase of the P ZERO^TM Experience Package or Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept the Terms and Conditions, as well as the documents referenced under section 2.5 and section 2.6, and keep a copy of the same for their own records.
3.2. A binding contract for the purchase of the P ZERO^TM Experience Package or Gift Voucher is made effective when the Buyer's purchase order (accompanied by the relevant payment as further detailed in Section 7 below) is accepted by the Seller upon dispatch to Buyer, at the e-mail address Buyer provided to the Seller during the purchase procedure, of an e-mail confirming that the order has been accepted (the “Order Confirmation”). Such email conformation will contain a link to the text of these Terms and Conditions, the documents referenced under section 2.5 and section 2.6, a summary of the order placed, including detailed price information, and
(i) in the case of purchase of a P ZERO^TM Experience Package, a description of the P ZERO^TM Experience Package ordered together with a univocal alphanumeric code and details of the Buyer and the Additional Driver (if any), the day of the Event, the number and name of Companions (as defined in Section 4.1), if any, and the model and license plate of the Car authorized to access the Circuit (such e-mail referred to as the “Access Pass”);
(ii) in case of a Gift Voucher purchase, the day of the Event, the name of the Buyer, the name and e-mail address of the Voucher’s Beneficiary (if applicable), the number of Companions (if any). In this case, the email confirmation will also contain a univocal coupon code (the “Coupon Code”) and all the steps to be followed in order to receive an Access Pass. The Voucher’s Beneficiary will be required to enter into an agreement with the Seller pursuant to which Voucher’s Beneficiary will be subject to the provisions of Sections 2.4 and 2.5, as a condition to receive an Access Pass.
3.3 The Buyer's order, Order Confirmation, and the Terms and Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.

4. Selection procedure and purchasing of the P ZERO^TM Experience Package and Gift Voucher

4.1. The P ZERO^TM Experience Package and Gift Voucher presented on the Site may be purchased by the Buyer's selection of the P ZERO^TM Experience Package and/or Gift Voucher (as applicable) of interest, and its placement in the virtual shopping cart. One (1) P ZERO^TM Experience Package or one (1) Gift Voucher may be purchased with each order. Each P ZERO^TM Experience Package purchased must include the Buyer, and, optionally, may include (at an additional cost as detailed on the Site) one (1) Additional Driver and up to 3 accompanying persons (hereinafter referred to as “Companion(s)”), in compliance with the P ZERO^TM Experience Regulations. In case Buyer wishes to purchase a Gift Voucher, the Gift Voucher may optionally include (at an additional cost as detailed on the Site) up to three (3) Companions, in compliance with the P ZERO^TM Experience Regulations. The names of the of the drivers of the Car registered by the Buyer or by the Voucher’s Beneficiary (including the Driver and any Additional Driver) can only be changed after completion of the purchase procedure, for justified and documented reasons as reasonably determined by Pirelli (such as, by way of example, illnesses and injuries) to be communicated to Pirelli Customer Service at least 2 (two) days before the Event. In this case, the person indicated as substitute driver (the “Substitute Driver”) must, prior to as a condition for participating in the Event, sign for acceptance the document that can be read and downloaded by clicking here. Furthermore, the Substitute Driver must show the Access Pass at the entrance to the Circuit on the day of the Event.
4.2. After having selected the P ZERO^TM Experience Package or Gift Voucher, the Buyer will be invited to provide Buyer’s personal data, as well as personal data of the Additional Driver and Companions, if any, or the personal data and e-mail of the Voucher’s Beneficiary and of the Companions (if any), in order to complete the order and enable the contract to be finalized. The Buyer will see a summary of the order to be processed containing the information detailed in Clause 3.2. After having read them carefully, the Buyer must then expressly approve these Terms and Conditions and the documents referenced under section 2.5 and section 2.6, by checking the appropriate boxes (check-box) on the Site and finally the Buyer will be asked to confirm Buyer‘s order by clicking the "BUY NOW” button and submit payment in accordance with Section 7 below. The order will then be final and sent to the Seller and will produce the effects described in the above section 3.2 of these Terms and Conditions.

5. Delivery and use of the P ZERO^TM Experience Package and/or Gift Voucher

5.1. To be able to use the P ZERO^TM Experience Package or Gift Voucher (as applicable), the Buyer our the Voucher’s Beneficiary (as applicable) must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of sections 2.5 and 2.6 of these Terms and Conditions.
5.2 The Buyer will be responsible for non-use or partial use of the P ZERO^TM Experience Package or the Gift Voucher due to incorrect indications or facts attributable to Buyer (including without limitation, incorrect indication of the email for receipt of the documentation relating to the Package P ZERO^TM Experience or of the purchased Gift Voucher, incorrect indication of data relating to the Buyer or entry to the Event with a different model of Car from those permitted).
5.3. If the Buyer or Voucher Beneficiary is absent on the day of the Event, the right to use the P ZERO^TM Experience Package will be lost, without prejudice to the provisions of section 8 below.

6. Prices

6.1. The prices of the P ZERO^TM Experience Package and the Gift Voucher are as indicated on the Site at the time the Buyer places the order. Final amounts to be paid include any applicable taxes.
6.2 The prices of the P ZERO^TM Experience Package and the Gift Voucher do not include the costs of board and lodging, travel to and from the Circuit, or any costs not expressly specified.
6.3. The Buyer must pay the Seller the total price, as stated in the order and confirmed in the Order Confirmation sent by e-mail from the Seller to the Buyer. In the event of a discrepancy between the price stated in the order and the price stated in the Order Confirmation, the price stated in the order shall prevail.

7. Payments

7.1. Payment of the price of the P ZERO^TM Experience Package or Gift Voucher purchased through the Site must be made at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly accepts that performance of the contract by the Seller will only start after the price of the P ZERO^TM Experience Package and/or Gift Voucher (as applicable) purchased is credited to the account of the Seller and all procedures set forth herein for Buyer to complete for the purchase of the P ZERO^TM Experience Package or Gift Voucher have been completed. Payment of the price of the P ZERO^TM Experience Package or Gift Voucher alone does not entitle any person to attend the Event or exercise any of the rights to which a Buyer is entitled hereunder upon completion of all procedures set forth herein.
7.2. . Payment must be made by credit card or PayPal and Buyer will be required to provide the relevant information through a protected connection. For accounting and administration purposes, the Seller reserves the right to check the personal information provided by the Buyer. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.
7.3. During the payment procedure, the Buyer will be transferred onto a protected site to the operator that provides acquiring services for the Seller. The data transmitted will be sent in protected mode, by encrypting the information with a 128-bit or higher SSL (SecureSocketLayer) system. Other than credit card authorization forms (if any) submitted to Seller, Seller cannot access this information.
7.4. The Seller will promptly transmit to the Buyer, in electronic format to the e-mail address provided by the latter, the receipt for the purchase made, or an electronic invoice, if requested at Customer Service.

8. Refund & Force Majeure

8.1. Should the Event be cancelled or the Buyer prevented from participating in the Event due to circumstances beyond Seller’s control, including but not limited to order(s) issued by local or national authorities related to epidemic, pandemic, organizational, safety, weather-related reasons, and/or any unavailability of the Circuit, the Buyer will not be entitled to any refund.
8.2 Cancellation of Buyer or Voucher’s Beneficiary (as applicable) participation in the Event can be requested by Buyer (before the Voucher’s Beneficiary receives the Access Pass) or by the Voucher’s Beneficiary (after the Voucher’s Beneficiary receives the Access Pass) by sending an e-mail with the reference line CANCELLATION and their first and last name to pzeroexperience.usa@pirelli.com. Entitlement to any refund of the purchase price of the P ZERO^TM Experience Package or Gift Voucher and the amount of any application refund will subject to receipt by Seller of the e-mail set forth in this Section 8.2 by 11:59 pm Eastern Standard Time as follows:
• request for cancellation 30 days or more prior to the start date of the Event: 100% refund of the purchase price of the P ZERO^TM Experience Package or Gift Voucher (as applicable);
• request for cancellation between 14 and 29 days prior to the start date of Event: 50% refund of the purchase price of the P ZERO^TM Experience Package or Gift Voucher (as applicable);
• request for cancellation 13 days or less prior to the start date of the Event: no refund.
8.3 Refunds requested after the Event has been cancelled shall not be valid. If the Buyer is entitled to a refund of the purchase price of the P ZERO^TM Experience Package or Gift Voucher, the Seller shall refund the relevant amount within 30 days from the communication of cancellation, except for any delays not attributable to the Seller. The Seller will make such refunds using the same means of payment used by the Buyer to purchase the P ZERO^TM Experience Package or Gift Voucher (as applicable. The effective time of the reimbursement depends on the payment cycle of the payment service; Seller is not responsible for the effective time of the reimbursement.
8.4 Seller is not responsible for any costs, fees, expenses or liabilities incurred by any Buyer, Driver, Additional Driver or Companion for any travel, lodging or other costs associated with travel to or attendance at the P ZERO^TM Experience Event, whether associated with an initial purchase of the P ZERO^TM Experience Package or Gift Voucher (as applicable) or in relation to cancellation or rescheduling of attendance at the Event.

9. Exclusion of the withdrawal right – Exclusion of liability

9.1 The Seller has no liability due to (i) non-receipt by the Buyer of the documentation on the P ZERO^TM Experience Package acquired due to reasons not imputable to the Seller or its agents or (ii) non- or partial utilzation of the P ZERO^TM Experience Package due to incorrect information provided by the Buyer (including, but not limited to, incorrect e-mail address, incorrect specification of the model and/or licence plate of the Car or information regarding the Buyer or Companions or regarding Driver’s license) or (iii) cancellation of the Event for reasons not imputable to the Seller or its agents.

10. Intellectual Property Rights

10.1. The Buyer acknowledges that it is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO^TM” trademark as well as any names, images, photographs, written text or graphics used on the Site or relating to P ZERO^TM Experience Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., Pirelli Tyre S.p.A. or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the Buyer in relation to the same as a result of access to the Site and/or purchase of the P ZERO^TM Experience Package or Gift Vouchers.
10.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

11. Personal data and protection of privacy

11.1. To be able to proceed to process the order and to enter into the contract based on these Terms and Conditions, certain personal information of the Buyer, Driver, Additional Driver, Companion and/or Voucher’s Beneficiary (as applicable) will be requested through the Site, as indicated in sections 4.2., 7 and 8. The Buyer and any such persons acknowledge that the personal data provided for the purpose of the purchase will be collected and used for the purposes indicated in the Privacy Policy(7).
11.2. The Buyer hereby declares and guarantees that the data provided during the registration and purchasing process is truthful, complete and accurate.
11.3. For any further information on how the personal data are processed, please refer to the Privacy Policy(8) .

12. Security

12.1. Although the Seller has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, the Seller cannot guarantee that the information or data displayed or provided by the Buyer on the Site, even after the Buyer has authenticated access (login), will not be accessible or viewable by unauthorized third parties.
12.2. With regard to credit card and PayPal payments, the Seller directly and through its agents adopts technological systems consistent with customary industry practices with respect to levels of reliability, security, protection and confidentiality in the transmission of information via the internet.

13. Applicable law and dispute resolution

13.1 TheseTermsandConditionssupersedeanyotheragreementbetweenBuyerandSellertotheextent necessary to resolve any inconsistency or ambiguity between them. These Terms and Conditions will be governed by and construed in accordance with the laws of the State of New York without giving effect to any principles of conflicts of laws and any conflict shall be resolved exclusively in the state and federal courts sitting in Manhattan, New York, New York. A printed version of these Terms and Conditions shall be admissible in judicial and administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same terms and conditions as other business documents and records originally generated and maintained in printed form. WHERE PERMITTED UNDER APPLICABLE LAW, BUYER AND THE SELLER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER RELATING TO THE SUBJECT MATTER HEREOF IN AN INDIVIDUAL CAPACITY AND NOT AS PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. BY PARTICIPATING IN P ZERO^TM EXPERIENCE PACKAGE YOU HEREBY IRREVOCABLY WAIVE THE RIGHT TO JOIN CLAIMS WITH OTHERS IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE AGAINST THE SELLER.

1. Subject

1.1. These general terms and conditions (hereinafter these “Terms and Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "P ZERO™ Experience Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a Gift Voucher for the P ZERO™ Experience (hereinafter the “Gift Voucher” and such person a “Voucher’s Beneficiary”), or (iii) has been indicated as Additional Driver, or (iv) has been indicated as substitute driver in the framework of the sale of a P ZERO Experience Package (hereinafter the “Substitute Driver”). Each of the Buyer from a Third Party, the Voucher’s Beneficiary, the Additional Driver and the Substitute Driver will be referred to as an “User” and, collectively, as “Users”. Users will receive an univocal code (hereinafter the "Coupon Code") for their respective registration, which is necessary for participation in the Event (as defined below). Each User must use the Coupon Code on the dedicated webpage [https://pzeroexperience.pirelli.com/en-us/freeexperience of the site https://pzeroexperience.pirelli.com/en-us/ (respectively the “Web Page” and the “Site”) in order to participate, at the The Motor Enclave (hereinafter the "Circuit") to a day on track (hereinafter the “Event”) with Buyer‘s own or authorized third party car, ”), subject to such car being on the list of approved vehicles published on the Site (each, a “Car”). The User must be the driver of the Car at the Circuit. The date available for the use of the P ZERO^TM Experience Package and the Gift Voucher (as applicable) and the relevant descriptions are published on the Site.
1.2. The Event is organized by Pirelli Tire LLC, with headquarters at 100 Pirelli Drive, Rome GA 30161 (hereinafter "PIRELLI").
Pirelli and Users, as the case may be, shall be referred to jointly as the "Parties".
Pursuant to these Terms and Conditions, persons whose details are registered as Buyer, Additional Driver, Substitute Driver (if any) or Voucher’s Beneficiary (as the case may be) during the purchase procedure of a P ZERO^TM Experience Package and/or Gift Voucher, are the only persons who will be entitled to drive the Car at the Circuit.
1.3. Any communication by an User, in connection with and/or in relation to the P ZERO^TM Experience Package and/or a Gift Voucher, including, but not limited to, during the registration process of the Coupon Code, shall be made to the addresses and in accordance with the procedures indicated on the Site or to the email address pzeroexperience.usa@pirelli.com (hereinafter the "Customer Service").
1.4.
1.7. The User shall be responsible for any costs incurred to connect to the Site via the internet, including any costs incurred by the Buyer with their internet service provider.

2. P ZERO^TM Experience Package and Gift Voucher features and important rules for the access to the Circuit

2.1. Each P ZERO^TM Experiences Package and Gift Voucher is provided by Pirelli with the features described and in accordance with the Terms and Conditions published on the Site.
2.2. Pirelli reserves the right to amend all or part of these Terms and Conditions and any other terms published on the Site, at any moment in time, and in Pirelli‘s sole discretion without giving any notice to Users. Any amendments shall become effective on the date on which they are published on the Site, but will only apply to registrations from that date onwards.
2.3. The characteristics of the P ZERO^TM Experience Package and/or Gift Voucher are subject to change without notice and, therefore, Pirelli does not assume any responsibility in the event of changes in the contents of the P ZERO^TM Experience Package, Gift Voucher and/or program variations. Such changes only apply to registrations made after the date of the contents change, provided that any changes to date or cancellation of the the P ZERO^TM Experience Package or Gift Voucher events are subject to section 5. In any case, User is advised to check the all information submitted before submitting a registration pursuant to section 3 below.
2.4. Users from all over the world can access this Site; however, the P ZERO^TM Experience Package and Gift Voucher available on the Site are only available to Users for performance in the United States of America and who otherwise met the requirements set forth in these Terms and Conditions and the P ZERO^TM Experience Regulations.
2.5. Access to the Circuit, following registration will be allowed only to Users who (each of whom complies with and represents that) (i) have completed the registration procedure on the Web Page using the Coupon Code, indicating any companions (the “Companions”) and/or additional driver (“Additional Driver”) or Substitute Driver, where applicable;
(ii) are the legitimate owners or possessors of the Cars;
(iii) are aged 21 or older and have a valid driving license, issued for at least 36 (months) months prior to the relevant P ZERO^TM Experience event and not subject to suspension or other sanctioning measures.
Access to the Circuit will not be allowed to people other than the Users, their registered Companions or to car(s) other than the Car(s) using the Cars identified in their Order registration on the Site.
Companions will be entitled to attend the Event, according to the P ZERO^TM Experience Regulations. No other person other than the respective User and Additional Driver (if any) will be permitted to drive a Car.
2.6. The access to the Circuit by each User is subject to the prior reading and acceptance, signature and delivery to Pirelli by such User of:

• (i) the P ZERO^TM Experience Regulations, which can be seen here
• (ii) waiver and releases which can be seen here or provided at the Circuit;

3. P ZERO^TM Experience Package and Gift Voucher registration procedure

3.1. Before proceeding with registration using the Coupon Code, User must carefully read and fully accept the Terms and Conditions, as well as the documents referenced under section 2.5 and section 2.6 by checking the appropriate boxes on the Web Page, and keep a copy of the same for their own records.
3.2. On the Web Page, the User will be asked to provide User’s personal data and the details of the Car User will drive during the Event, as well as personal data of the Companions and of the Additional Driver, if any and as applicable, in order to complete the registration process for the attendance to the Event.
3.3 User’s registration is accepted by the Pirelli (and User is bound to these Terms and Conditions) upon dispatch to User, at the e-mail address User provided to Pirelli during the registration process procedure, of an e-mail confirming that such registration has been successfully completed. Such email conformation will contain a link to the text of these Terms and Conditions, the documents referenced under section 2.5 and section 2.6, the name of the natural person who owns the P ZERO™ Experience Package or the Gift Voucher, the names of any Substitute Driver, Companions and Additional Driver, the day of the Event, the model and license plate of the Car authorized to access the Circuit and a description of the Event ("Access Pass").
3.4 The The Access Pass, and the Terms and Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and User may request copies by sending an e-mail to Customer Service.
3.5 The names of the of the Buyer from a Third Party, the Voucher’s Beneficiary and the Additional Driver’s names (if any) can only be changed once and after the receipt of the Access Pass for justified and documented reasons as reasonably determined by Pirelli (such as, by way of example, illnesses and injuries) to be communicated to Pirelli Customer Service by User at least 2 (two) days before the Event. In this case, the person indicated as substitute driver (the “Substitute Driver”) must, prior to as a condition for participating in the Event, sign for acceptance the document that can be read and downloaded by clicking here. Furthermore, the Substitute Driver must show the Access Pass at the entrance to the Circuit on the day of the Event.
3.6. User acknowledge and agrees that, as part of Buyer’s purchase of the P ZERO^TM Experience Package or Gift Voucher for User’s benefit, Buyer provided User’s
personal data in order to complete the order and enable the contract to be finalized. User will see a summary of such information . By completing the registration process for the Event, user acknowledges and agrees to having read them carefully and expressly approves these Terms and Conditions and the documents referenced under section 2.5 and section 2.6, by checking the appropriate boxes (check-box) on the Site and finally the User will be asked to confirm User’s registration by clicking the "REGISTER=” button. The registration will then be final and sent to Pirelli and will produce the effects described in the above section 3.2 of these Terms and Conditions.

4. Delivery and use of the P ZERO^TM Experience Package and/or Gift Voucher

4.1. To be able to use the P ZERO^TM Experience Package or Gift Voucher (as applicable), User must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of sections 2.5 and 2.6 of these Terms and Conditions.
4.2 User will be responsible for non-use or partial use of the P ZERO™ Experience Package or the Gift Voucher due to incorrect indications or facts attributable to User (including without limitation, incorrect indication of the email for receipt of the documentation relating to the P ZERO™ Experience or Gift Voucher, incorrect indication of data relating to the User or entry to the Event with a different model of Car from those permitted).
4.3. If User is absent on the day of the Event, the right to use the P ZERO^TM Experience Package or Gift Voucher will be lost, without prejudice to the provisions of section 5 below.


5. Cancellation Communications & Force Majeure

5.1. Should the Event be cancelled or the Buyer prevented from participating in the Event due to circumstances beyond Seller’s control, including but not limited to order(s) issued by local or national authorities related to epidemic, pandemic, organizational, safety, weather-related reasons, and/or any unavailability of the Circuit, the User will not be entitled to any refund.
5.2 Cancellation of User’s participation in the Event can be requested by User (after User receives the Access Pass) by sending an e-mail with the reference line CANCELLATION and their first and last name to pzeroexperience.usa@pirelli.com. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by Pirelli to the purchaser of the Gift Voucher or by the entity who has sold the P ZERO™ Experience Package to the Buyer from a Third Party.

6. Exclusion of the withdrawal right – Exclusion of liability

6.1 Pirelli has no liability due to (i) non-receipt by the User of the documentation on the P ZERO^TM Experience Package or Gift Voucher received due to reasons not imputable to Pirelli or its agents or (ii) non- or partial utilization of the P ZERO^TM Experience Package or Gift Voucher due to incorrect information provided by the relevant purchaser or User (including, but not limited to, incorrect e-mail address, incorrect specification of the model and/or license)plate of the Car or information regarding the User or their Driver’s licenses) or (iii) cancellation of the Event for reasons not imputable to Pirelli or its agents.

7. Intellectual Property Rights

7.1. User acknowledges that it is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any names, images, photographs, written text or graphics used on the Site/Web Page or relating to P ZERO™ Experience Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., Pirelli Tyre S.p.A. or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the Buyer in relation to the same as a result of access to the Site/Web Page and/or purchase of the P ZERO™ Experience Package or Gift Vouchers.
7.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/ Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

8. Personal data and protection of privacy

8.1. To be able to proceed with User’s the registration process for the purpose of participating in the Event and based on these Terms and Conditions, certain personal information of User and/or Companion (as applicable) will be requested through the Site, as indicated herein. User and any such persons acknowledge that the personal data provided for the purpose of the registration process will be collected and used for the purposes indicated in the Privacy Policy(7).
8.2. User hereby declares and guarantees that the data provided during the registration process is truthful, complete and accurate.
8.3. For any further information on how User and Companion personal data are processed, please refer to the Privacy Policy(8) .

9. Security
9.1. Although Pirelli has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, Pirelli cannot guarantee that the information or data displayed or provided by the User on the Site and/or the Web Pagewill not be accessible or viewable by unauthorized third parties.

10. Applicable law and dispute resolution

10.1 These Terms and Conditions supersede any other agreement between the Parties to the extent necessary to resolve any inconsistency or ambiguity between them. These Terms and Conditions will be governed by and construed in accordance with the laws of the State of New York without giving effect to any principles of conflicts of laws and any conflict shall be resolved exclusively in the state and federal courts sitting in Manhattan, New York, New York. A printed version of these Terms and Conditions shall be admissible in judicial and administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same terms and conditions as other business documents and records originally generated and maintained in printed form. WHERE PERMITTED UNDER APPLICABLE LAW, THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER RELATING TO THE SUBJECT MATTER HEREOF IN AN INDIVIDUAL CAPACITY AND NOT AS PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. BY PARTICIPATING IN P ZERO^TM EXPERIENCE YOU HEREBY IRREVOCABLY WAIVE THE RIGHT TO JOIN CLAIMS WITH OTHERS IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE AGAINST PIRELLI.

1. Subject

1.1 These general terms and conditions of sale (hereinafter the “Conditions”) shall apply to the purchase, by users falling within the definition of “Consumers” and of “Professionals” (as defined in clause 1.2 below), through the website pzeroexperience.pirelli.com/en-gb/circuits/silverstone (hereinafter the “Site”) of the package named “P ZERO™ Experience” (hereinafter the "PZE Package" or the "PZE Packages") or a gift voucher for the PZE Package (“Gift Voucher”) which will entitle the Buyer (as defined in clause 1.2 below) and the Voucher Beneficiary (defined in clause 2.5 below) to participate, at the Silverstone Circuit (hereinafter the "Circuit") in a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”).

The dates available for the Event and the descriptions of the PZE Package are published on the Site.

1.2 The PZE Packages and Gift Vouchers are sold by Pirelli UK Tyres Limited, with its registered office at Derby Road, Burton on Trent, DE13 0BH (hereinafter, the "Seller").

The parties involved in the purchase of PZE Packages or Gift Vouchers (as applicable) via the Site shall be the Seller and the party who purchases the PZE Packages or Gift Vouchers (as applicable) either: (i) for reasons other than in relation to the profession, business, trade or craft conducted by that party or that of another party (hereinafter the "Consumer"); or (ii) in relation to the profession, business, trade or craft conducted by that party, (hereinafter the "Professional"); as the buyers (the Consumer and the Professional shall individually be referred to as the “Buyer” and jointly as the “Buyers”). The Seller and the Buyer, as the case may be, shall be referred to jointly as the "Parties".

During the purchasing procedure of the PZE Package or the Gift Voucher (as applicable) the Buyer will be required to enter the details of the person(s) who are to drive the Car at the Circuit. (“Driver”)

1.3 Any communication by the Buyer, in connection with and/or in relation to the purchase of a PZE Package or Gift Voucher (as applicable), including, but not limited to any notifications, claims or requests concerning the purchase and/or delivery of the PZE Package or Gift Voucher (as applicable), shall be made to the Seller at the addresses and in accordance with the methods indicated on the Site or to the email address pzeuk@pirelli.com (hereinafter the "Customer Service").

1.4. All purchases are regulated by the Conditions, as published on the Site at the time the order is submitted by the Buyer.

1.5. If one or more sales are made to a Professional, the Conditions shall apply but, notwithstanding the provisions of the same:
the Professional will not be recognised by any other protections provided herein in favour of Consumers, which reflect or comply with mandatory provisions of law;
b) for disputes between the Seller and a Professional, clause 12.4 of the Conditions, referring to disputes between the Seller and a Consumer shall not apply.

1.6. Buyers must be aged 18 or over in order to make purchases of PZE Packages or Gift Vouchers on the Site and to access the Circuit and participate in such events.

1.7. The Buyer shall be responsible for any costs incurred to connect to the Site via the internet, including any telephony costs incurred by the Buyer with their service provider.

2. Features and important rules for the access to the Circuit

2.1. The PZEs Packages and Gift Vouchers are sold by the Seller with the features and in accordance with the Conditions published on the Site at the time the order is sent by the Buyer, with the exclusion of any other terms or conditions.

2.2. The Seller reserves the right to amend all or part of the Conditions, at any moment in time, and at its own discretion without giving any notice to users of the Site. Any amendments made shall come into force from the date on which they are published on the Site and will only apply to orders placed from that date onwards.

2.3. Sale prices, the PZE Packages and Gift Vouchers sold on the Site and/or the characteristics of the same, are subject to change without notice and therefore, the Seller does not assume any responsibility in the event of changes in the contents of the PZE Package, Gift Voucher and/or program variations. Such changes shall only apply to orders placed after the date of such changes being implemented. In any case, the Buyer is advised to check the final purchase price before submitting their order, pursuant to clause 3 below.

2.4. Users from all over the world may access the Site; however, the PZE Package and Gift Vouchers available on the Site should only be purchased by users who wish to participate in such event in the UK at the Circuit. During the purchasing procedure, the Buyer will have the option to purchase a Gift Voucher for a third party, natural person (“Voucher Beneficiary”).

2.5 Access to the Circuit, following the purchase of a PZE Package or Gift Voucher, will only be allowed to the Buyer or Voucher Beneficiary (as applicable): (i) whose vehicle features on the list of Cars published on the Site; and who (ii) hold a valid driving licence entitling them to drive such vehicles. A Companion will be entitled to attend the Event in accordance with the PZE Regulations (defined in clause 2.6(ii) below).

2.6 Access to the Circuit by each Buyer or Voucher Beneficiary is subject to:
(i) the unconditional acceptance and agreement by the Buyer or Voucher Beneficiary (as applicable) of the indemnity documents that the Seller and the car manufacturers will ask the Buyer or Voucher Beneficiary (as applicable) to sign, which can be seen here;
(ii) the acceptance and agreement to the PZE regulations (which incorporate any Circuit regulations), which can be seen here (“PZE Regulations”). 3. Conclusion of each individual purchase contract

3.1. Each order submitted by the Buyer to the Seller via the Site has the value of a contractual proposal and is subject to the Conditions which form an integral part of the order and which the Buyer, by placing the order, fully accepts without any reservation. Before proceeding with the purchase of the PZE Package or Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept (and print and/or save copies, for their records of) the Conditions together with the documents detailed in clause 2.6.

3.2. A contract is formed when the Buyer's order (accompanied by the relevant payment as further detailed in clause 7) is accepted by the Seller by sending to the Buyer (at the e-mail address provided by the Buyer during the purchase procedure) an e-mail confirming that the order has been accepted ("Order Confirmation"). This email confirmation will contain a link to the text of the Conditions, a summary of the order placed (including detailed price information and date), and a description of the PZE Package ordered together with a pdf attachment containing the unique alphanumeric code and details of the Driver, the name of the Buyer’s accompanying person (if any), and the model and licence plate of the Car participating at the Circuit (hereinafter, the “Pass”). Voucher Beneficiaries will be subject to the provisions of clause 2.5 and 2.6 of the Conditions and may be required to enter into an agreement with the Seller in respect thereof.

3.3. The Buyer's order, the Order Confirmation and the Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.

4. Selection and purchasing procedure

4.1. The PZE Packages and Gift Vouchers presented on the Site can be purchased by the Buyer's selecting the PZE Package or Gift Voucher of interest and placing it in the virtual purchase basket. One (1) PZE Package and/or one (1) Gift Voucher may be purchased with each order. Each PZE Package purchased must include the Buyer and optionally, one additional accompanying person (at an additional cost as detailed on the Site). For each Gift Voucher purchase, the Buyer can optionally include up to one (1) Companion, in compliance with the PZE Regulations. The name of the Buyer or Voucher Beneficiary (as applicable) cannot be changed after the purchase and no other persons will be permitted to drive the Car at the Circuit.

4.2 After having selected the PZE Package or Gift Voucher the Buyer will be invited to provide his/her personal data or that of the Voucher Beneficiary (as applicable) and any Companion in order to complete the order and purchase of the PZE Package or Gift Voucher in their basket and enable the contract to be finalised. The Buyer will see a summary of the order to be processed, containing the information detailed in clause 3.2 above. Having read them carefully, the Buyer must then expressly approve the Conditions and the documents referenced under clause 2.6, by checking the appropriate boxes (check-box) on the Site and finally, the Buyer will be asked to confirm his/her order with the "PURCHASE" button and submit payment in accordance with clause 7 below. The order will then be sent to the Seller and an Order Confirmation issued, as detailed in clause 3.2 above.

5. Delivery and use of the PZE Package and/or Gift Voucher

5.1 To be able to use the PZE Package or Gift Voucher, the Buyer or Voucher Beneficiary (as applicable) must show the Pass (as defined in clause 3.2 above) at the entry to the Circuit on the day of the Event, and comply with the provisions of clauses 2.5 and 2.6 above.

5.2 If the Buyer or Voucher Beneficiary (as applicable) is absent on the day of the Event, the right to use the PZE Package or Gift Voucher (as applicable) will be lost, without the possibility of reimbursement.

6. Prices

6.1. The price of a PZE Package and Gift Voucher is as indicated on the Site at the time the Buyer sends the order. Prices include VAT.

6.2. For the avoidance of doubt, the prices on the Site do not include the costs of any accommodation, travel to and/or from the Circuit, or any costs not expressly specified.

7. Payments

7.1. Payment of the price of the PZE Package and/or Gift Voucher purchased through the Site will be taken by the Seller at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly accepts that execution of the contract by the Seller will only start after the price of the PZE Package or Gift Voucher purchased is credited to the current account of the Seller.

7.2. Payment must be made by credit or debit card or by Paypal, and the Buyer will therefore be required to provide the relevant information through a protected connection. For accounting and administration purposes, the Seller reserves the right to check the personal information provided by the Buyer. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.

7.3. During the payment procedure, the Buyer will be transferred on a protected site to the operator that provides acquiring services for the Seller. The data transmitted will be sent in protected mode, by encrypting the information with a 128 bit or higher SSL (SecureSocketLayer) system. The Seller cannot access this information.

7.4. The Seller will promptly transmit to the Buyer, in electronic format to the e-mail address provided by the Buyer, the VAT receipt for the purchase made.

8. Cancellation - Refund

8.1. The Seller will not be liable to the Buyer for failure to perform any of its obligations to the extent that the failure is caused by a force majeure event (meaning any cause beyond the Seller’s reasonable control including without limitation, acts of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments or any epidemic or pandemic). In the event of imposition of governmental restrictions (for example reference mobility or the ability to hold such events), the Seller shall offer an alternative date (if possible) or provide a full refund to the Buyer, at the Buyer’s discretion. This clause does not affect the terms of clause 8.2 below, specifically providing for a right of refund in any other circumstances. 

8.2. In the event that the Buyer wishes to cancel his/her participation in the PZE Package or a purchased Gift Voucher, the Buyer’s entitlement to any refund will be as follows:
- cancellation 30 days or more prior to the date of the PZE Package: 100% refund
- cancellation between 14 to 29 days prior to the date of the PZE Package: 50% refund
- cancellation of 13 days or less prior to the date of the PZE Package: no refund

8.3 Any cancellations must be communicated to the Seller by sending an e-mail to Customer Service. In case the Buyer is entitled to a refund, the Seller shall refund the relevant amount without undue delay. The Seller will make such refund using the same means of payment (credit/debit card or Paypal) used by the Buyer for purchase of the PZE Package or Gift Voucher (as applicable). The Buyer will receive, within 7 days from his/her communication of cancellation, an email from Seller informing that the authorisation to the refund has been transmitted to the payment circuit used by the Buyer for the purchase. The effective time of refund will depend on such payment circuit and no responsibility will be attributable to the Seller for the effective time refund.

8.4. The Seller shall not be liable for occasions where the Buyer or Voucher Beneficiary is unable to access the Circuit due to: (i) non-receipt of the order documentation containing the requested information; or (ii) incorrect information provided by the Buyer (for example, incorrect e-mail address, incorrect specification of the model and/or licence plate of the Car to be used on the Circuit or incorrect information regarding the Buyer or Voucher Beneficiary).

9. Intellectual Property Rights

9.1. The Buyer acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site or relating to PZE Packages or Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., Pirelli Tyre S.p.A. or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the Buyer in relation to the same as a result of access to the Site and/or purchase of the PZE Packages or Gift Vouchers.

9.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

10. Personal data of the Buyer and protection of privacy

10.1. To be able to proceed to process the order and conclude the contract based on the Conditions, some personal information of the Buyer and/or the Voucher Beneficiary (as applicable) will be requested through the Site, as indicated in clauses 7 and 8. The Buyer acknowledges that the personal data he/she provides for the purpose of the purchase will be collected and used for the purposes indicated in the Seller's Privacy Policy. The Buyer acknowledges that the Seller's Privacy Policy regarding the processing of personal data for the purposes of the PZE Packages or Gift Vouchers can be accessed through the Site.

10.2. The Buyer declares and guarantees that the data provided during the purchasing process are correct and true.

11. Security

11.1. Although the Seller has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, the Seller cannot guarantee that the information or data input by the Buyer on the Site, even after the Buyer has authenticated access (login), will not be accessible or viewable by unauthorized third parties.

11.2. With regard to card and Paypal payments, the Seller adopts technological systems to guarantee the highest levels of reliability, security, protection and confidentiality in the transmission of information via the web.

12. Applicable law, conciliation and jurisdiction

1. Each purchasing contract entered into between the Seller and the Buyer pursuant to the Conditions shall be governed by and construed in accordance with English Law and, in particular, for Consumers, in accordance with the Consumer Contract Regulation 2013, the Consumer Rights Act 2015 and, also for the Professionals, in accordance with the Supply of Goods and Services Act 1982. In any case, the rights attributed to the Consumers by mandatory provisions of laws, when applicable, are reserved.

2. In case of any queries or complaints regarding a purchase, please contact the Seller using the Customer Service contact details, quoting any order reference numbers.

3. If any dispute arises, the Seller shall use its reasonable endeavours to consult or negotiate in good faith and attempt to reach a just and equitable settlement satisfactory to the Buyer.

4. As an alternative to the conciliation attempt referred to in the preceding clauses, the Consumer, in order to resolve any dispute arising between the latter and the Seller, may also access the European Online Dispute Resolution platform (the European ODR Platform). The European ODR Platform has been developed and is managed by the European Commission, in accordance with Directive no. 2013/11/EU and Regulation EU no. 524/2013, in order to facilitate an independent, impartial, transparent, efficient, rapid and just resolution of out-of-court disputes relating to contractual obligations arising out of online sale or service contracts between a consumer residing in the European Union and a professional established within the EU, through the intervention of an ADR (“Alternative Dispute Resolution”) body, to be selected from a list available thereof. 5. In the event that the Consumer or the Seller does not adhere to one of the conciliation attempts referred to in clauses 12.3 or 12.4 above, or such attempt has a negative outcome, the dispute shall be deferred to the jurisdiction of the Courts of England or Wales.

6. In case of disputes arising between the Seller and a Professional, the same shall be deferred to the exclusive jurisdiction of the Courts of England and Wales.

1. Subject

1.1. These general terms and conditions of sale (hereinafter the “Conditions”) shall apply to the purchase, by users falling within the definition of “Consumers” and of “Professionals”, pursuant to the following Clause 1.2, through the website https://pzeroexperience.pirelli.com/en-it/circuits/mugello (hereinafter the “Site”) of the package named “P ZERO™ Experience” or the gift voucher for the P ZERO™ Experience (hereinafter respectively the "P ZERO™ Experience Package" and the "Gift Voucher”) which will entitle the Buyer and the Voucher’s Beneficiary (as defined in Clause 2.5 below) to participate, at the Mugello Circuit (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”).

The dates available for the use of the PZERO^TM Experience Package and the Gift Voucher (as applicable) and their descriptions are published on the Site.

1.2. The P ZERO™ Experience Package and the Gift Voucher are sold by Pirelli Tyre S.p.A, a joint stock company with a sole shareholder - management and coordination of Pirelli & C. S.p.A., with registered office in Viale Piero e Alberto Pirelli, 25 – 20126 Milan (Italy), Tax Code, VAT No. and Milan, Monza Brianza and Lodi Business Registry Enrolment No. 07211330159, R.E.A of Milan 1147607, (hereinafter the "Seller").

The parties involved in the purchase of the P ZERO™ Experience Package and the Gift Voucher (as applicable) via the Site shall be the Seller and the party who purchases the P ZERO™ Experience Package for reasons other than in relation to the profession, business, trade or craft conducted by that party or that of another party (hereinafter the "Consumer"), or in relation to the profession, business, trade or craft conducted by that party (hereinafter the "Professional") as the buyers (the Consumer and the Professional shall individually be referred to as the “Buyer” and jointly as the “Buyers”). The Seller and the Buyer, as the case may be, shall be referred to jointly as the "Parties". Pursuant to the Conditions, the people whose details are registered as the Buyer, the Additional Driver (if any) or the Voucher’s Beneficiary (if applicable) during the purchase procedure of the P ZERO™ Experience Package and/or the Gift Voucher, are the people who will be the only one(s) to be entitled to drive the Car at the Circuit.

1.3. Any communication by the Buyer, in connection with and/or in relation to the purchase of the P ZERO™ Experience Package and/or the Gift Voucher (as applicable), including, but not limited to any notifications, claims or requests concerning the purchase of the P ZERO™ Experience Package and/or the Gift Voucher (as applicable), shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeroexperienceitalia@pirelli.com (hereinafter the "Customer Service").

1.4. All purchases are regulated by the Conditions published on the Site at the time the order is submitted by the Buyer.

1.5. If one or more sales are made to a Professional, the Conditions shall apply but, notwithstanding the provisions of the same: a) the Professional will not be recognized any other protections provided herein, in favor of the Consumer, which reflect or comply with mandatory provisions of law;
b) for disputes between the Seller and a Professional, Articles 13.2 – 13.4 of the Conditions, referring to disputes between the Seller and a Consumer shall not apply.
1.6. When the purchase order is transmitted, the Buyer accepts that confirmation of the information on the order made, and on these Conditions, sent to them via e-mail to the address they provided during registration on the Site, or during the purchase process.

1.7. Buyers must be aged 21 or over in order to make purchases of the P ZERO^TM Experience Package on the Site. Differently, the Buyer who wants to purchase only the Gift Voucher on the Site can be 18 years of age or over but the Voucher’s Beneficiary must be aged 21 or over. In both cases, the Buyer of the P ZERO^TM Experience Package or the Gift Voucher must have legal capacity.

1.8. The Buyer shall be responsible for any costs incurred to connect to the Site via the internet, including any telephony costs incurred by the Buyer with their service provider.

2. The P ZERO™ Experience Package and Gift Voucher features and important rules for the access to the Circuit.

2.1. The P ZERO™ Experiences Package and the Gift Voucher are sold by the Seller with the features and in accordance with the Conditions published on the Site, at the time the order is sent by the Buyer, with the exclusion of any other terms or conditions.

2.2. The Seller reserves the right to amend all or part of these Conditions, at any moment in time, and as its own discretion without giving any notice to users of the Site. Any amendments shall come into force from the date on which they are published on the Site, and will only apply to orders placed from that date onwards.

2.3. Sales prices, the P ZERO™ Experience Package and Gift Voucher sold on the Site and/or the characteristics of the same, are subject to change without notice and, therefore, the Seller does not assume any responsibility in the event of changes in the contents of the P ZERO™ Experience Package, Gift Voucher and/or program variations. Such changes only apply to orders placed after the date of such changes be implemented. In any case, the Buyer is advised to check the final purchase price, before submitting the order, pursuant to Clause 3 below.

2.4. Users from all over the world may access this Site; however, the P ZERO™ Experience Package and the Gift Voucher, available on the Site, should only be purchased by users who request their execution in Italy.

2.5. During the purchase procedure of the P ZERO™ Experience Package, the Buyer will have the choice to select one (1) additional driver (the “Additional Driver”), or the option to purchase a Gift Voucher selecting the P ZERO^TM Experience Package for a third party, natural person (hereinafter the "Voucher’s Beneficiary“). 2.6. Access to the Circuit, following the purchase of a P ZERO™ Experience Package or a Gift Voucher (as applicable), will be allowed to Buyer, Additional Driver and Voucher’s Beneficiary (as applicable) who:
(i) are legitimate owners/keepers of the Car(s) and
(ii) are aged 21 or over and have a driving license in the course of validity, issued for at least 36 (thirty six) months and not subject to suspension or other sanctioning measures. Access to the Circuit will not be allowed to people other than the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) nor to car(s) other than the Car(s).

Companions will be entitled to attend the Event, according to the P ZERO™ Experience regulations.

2.7. Access to the Circuit by each Buyer, Additional Driver or Voucher’s Beneficiary (as applicable) is subject to:
(i) the unconditional acceptance and agreement by the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) of the Circuit regulations;

(ii) the acceptance and agreement by the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) of the P ZERO™ Experience regulations (inclusive of the Covid-19 Safety and Hygiene Measures) which will be provided by the Seller and which can be read and downloaded here;

(iii) the unconditional acceptance and agreement by the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) of the indemnity documents that the Circuit and the Seller will ask them to sign. Click here to read and download the indemnity documents of the Circuit and the Seller.

3. P ZERO™ Experience Package and Gift Voucher purchase procedure – Conclusion of each individual purchase contract.

3.1. Each order submitted by the Buyer to the Seller via the Site has the value of a contractual proposal and is subject to these Conditions which form an integral part of the purchase order and which the Buyer, by placing the order, fully accepts without any reservation. Before proceeding with the purchase of the P ZERO™ Experience Package or a Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions together with the documents detailed in Clause 2.7 above.

3.2. A contract is formed when the Buyer's order (accompanied by the relevant payment as further detailed in Clause 7) is accepted by the Seller by sending to them (at the e-mail address provided by the Buyer during the purchase procedure) an e-mail confirming that the order has been accepted (the “Order Confirmation”). This email confirmation will contain a link to the text of these Conditions and to the documents to be signed before accessing the Circuit, a summary of the order placed, including detailed price information and:

(i) in case of a P ZERO™ Experience purchase, a description of the P ZERO™ Experience Package ordered together with a univocal alphanumeric code and details of the Buyer and the Additional Driver (if any), the day of the Event, the number and name of Companions (as defined in Clause 4.1), if any, and the model and licence plate of the Car authorised to access the track (the e-mail is referred to as the “Access Pass”);

(ii) in case of a Gift Voucher purchase, the day of the Event, the name of the Buyer, the name and e-mail address of the Voucher’s Beneficiary (if applicable), the number of Companions (if any). In this case, the email confirmation will also contain a univocal coupon code (the “Coupon Code”) and all the steps to be followed in order to receive the Access Pass. The Voucher’s Beneficiary will be requested to enter into an agreement with the Seller in which he/she will be subject to the provisions of Clause 2.6 and 2.7.

3.3. The Buyer's order, the Order Confirmation and the Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.

4. Selection procedure and purchasing of the P ZERO™ Experience Package and Gift Voucher

4.1. The P ZERO™ Experience Package and the Gift Voucher presented on the Site may be purchased by the Buyer's selecting the P ZERO™ Experience Package and/or the Gift Voucher (as applicable) of interest and placing it in the virtual purchase basket. One (1) P ZERO™ Experience Package and/or one (1) Gift Voucher may be purchased with each order. Each P ZERO™ Experience Package purchased must include the Buyer, and, optionally (at an additional cost as detailed on the Site) one (1) Additional Driver and up to three (3) accompanying persons (hereinafter the "Companions"), in compliance with the P ZERO™ Experience regulations. In case the Buyer wishes to purchase a Gift Voucher, the Gift Voucher can optionally include (at an additional cost as detailed on the Site) up to three (3) Companions, in compliance with the P ZERO™ Experience regulations.

4.2. The name of the Buyer, the Additional Driver (if any) and the Voucher’s Beneficiary cannot be changed after the purchase procedure and no other person will be permitted to drive the Car registered by the Buyer or by the Voucher’s Beneficiary, as applicable.

4.3. After having selected the P ZERO™ Experience Package or the Gift Voucher, to complete the purchase of the P ZERO^TM Experience Package or the Gift Voucher (as applicable) in its basket, the Buyer will be invited to provide his/her personal data as well as the personal data of the Additional Driver and of the Companions (if any), or the personal data and e-mail of the Voucher’s Beneficiary and of the Companions (if any), in order to complete the order and enable the contract to be finalised.

The Buyer will see a summary of the order to be processed, containing the information detailed in Clause 3.2. Having read them carefully, the Buyer must then expressly approve these Conditions and the specific clauses (including the documents indicated in Clauses 2.6 and 2.7), by checking the appropriate box (check-box) on the Site and finally the Buyer will be asked to confirm his/her order with the "PURCHASE" button and submit payment in accordance with Clause 7 below. The order will then be sent to the Seller and will produce the effects described in the above Clause 3.2.

5. Delivery and use of the P ZERO™ Experience Package and/or of the Gift Voucher

5.1. To be able to use the P ZERO™ Experience Package or the Gift Voucher, as applicable, the Buyer or the Voucher’s Beneficiary (as applicable) must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of clauses 2.6 and 27 above. 5.2. If the Buyer or the Voucher’s Beneficiary (as applicable) are absent on the day of the Event, the right to use the P ZERO™ Experience Package will be lost, without possibility of reimbursement. 6. Prices

6.1. The prices of the P ZERO™ Experience Package and of the Gift Voucher are indicated on the Site at the time the Buyer sends the order. Prices include VAT (at 22%).

6.2. The prices of the P ZERO™ Experience Package and of the Gift Voucher do not include the costs of board and lodging, travel to and from the Circuit, or any costs not expressly specified.

6.3. The Buyer must pay the Seller the total price, as stated in the order and in the order confirmation sent by e-mail from the Seller to the Buyer.

7. Payments

7.1. Payment of the price of the P ZERO™ Experience Package and of the Gift Voucher purchased through the Site must be made at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly accepts that execution of the contract by the Seller will only start after the price of the P ZERO™ Experience Package or the Gift Voucher purchased, as applicable, is credited to the current account of the Seller.

7.2. Payment must be made by credit card or PayPal and the Buyer will therefore be required to provide the relevant information through a protected connection. For accounting and administration purposes, the Seller reserves the right to check the personal information provided by the Buyer. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.

7.3. During the payment procedure, the Buyer will be transferred on a protected site to the operator that provides acquiring services for the Seller. The data transmitted will be sent in protected mode, by encrypting the information with a 128-bit or higher SSL (SecureSocketLayer) system. Not even the Seller can access this information.

7.4. The Seller will promptly transmit to the Buyer, in electronic format to the e-mail address provided by the latter, the tax receipt for the purchase made, or an electronic invoice, if requested.

8. Cancellation – Conditions for refund
8.1. Should the Event be cancelled due to force majeure (including any epidemic or pandemic) or organisational, safety, weather-related reasons, orders issued by authorities and/or any unavailability of the Circuit, the Buyer will not be entitled to any refund.

This clause does not affect the terms of Clause 8.3 herebelow, specifically providing for a right of refund. 

8.2 Should the Buyer or the Additional Driver or the Voucher’s Beneficary (as applicable) be prevented from participating to the Event due to order(s) issued by local or national authorities (by way of example bans or border closures), the Buyer will be entitled to choose between a full refund or a voucher to be used in one of any P ZERO™ events taking place in Europe by the end of 2022. Any other reimbursement is expressly excluded.

8.3. In the event that the Buyer or the Voucher’s Beneficiary (as applicable) wishes to cancel his/her participation in the Event, the Buyer’s entitlement to any refund will be as follows:

- cancellation 30 days or more prior to the date of the Event: 100% refund
- cancellation between 14 to 29 days prior to the date of the Event: 50% refund
- cancellation of 13 days or less prior to the date of the Event: no refund.

8.4. Cancellation has to be made by the Buyer (before the Voucher’s Beneficiary receives the Access Pass) or by the Voucher’s Beneficiary (after the Voucher’s Beneficiary receives the Access Pass) by sending an e-mail to the Customer Service. In case the Buyer is entitled to a refund, the Seller shall refund the relevant amount without undue delay and in any event no later than 14 days from the communication of cancellation, exception made for delays not attributable to the Seller. The Seller will make such refunds using the same means of payment used by the Buyer to purchase the P ZERO™ Experience Package or the Gift Voucher.

9. Exclusion of the withdrawal right – Exclusion of liability

9.1. The Buyer may not exercise the right of withdrawal pursuant to the combined provisions of article 49, subsection m), and article 59, subsection n), of legislative decree 206/2005 (hereinafter, the "Consumer Code").

9.2. The Seller has no liability for (i) non-receipt by the Buyer or by the Voucher’s Beneficiary of the documentation on the P ZERO™ Experience Package or the Gift Voucher acquired, or due to (ii) non - or partial - utilisation of the P ZERO™ Experience Package or of the Gift Voucher due to incorrect information provided by the Buyer (for example, incorrect e-mail address, incorrect specification of the model and/or licence plate of the vehicle or information regarding the Buyer and/or the Voucher’s Beneficiary) or (iii) due to cancellation of the event to which the P ZERO^TM Experience Package acquired pertains for reasons not imputable to the Seller.

10. Intellectual Property Rights

10.1. The Buyer acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site or relating to P ZERO™ Experience Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., of the Seller . or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the Buyer in relation to the same as a result of access to the Site and/or purchase of the P ZERO™ Experience Packages or Gift Vouchers.

10.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

11. Personal data and protection of privacy

11.1. To be able to proceed to process the order and the conclude the contract based on these Conditions, some personal information of the Buyer, of the Additional Driver, of the Companions and of the Voucher’s Beneficiary, as applicable, will be requested through the Site, as indicated in Clauses 4.3 and 7. The Buyer acknowledges that the personal data he/she themselves provides for the purpose of the purchase will be collected and used for the uses indicated in the Seller's Privacy Policy.

11.2. The Buyer declares and guarantees that the data provided during the purchasing process are correct and true. 11.3. For any other information relating to the processing of the personal data of the Buyer and the Companions, please refer to the Privacy Policy. 12. Security

12.1. Although the Seller has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, the Seller cannot guarantee that the information or data displayed by the Buyer on the Site, even after the Buyer has authenticated access (login), will not be accessible or viewable by unauthorized third parties.

12.2. With regard to credit card and Paypal payments, the Seller adopts technological systems to guarantee the highest levels of reliability, security, protection and confidentiality in the transmission of information via the web.

13. Applicable law, conciliation and jurisdiction

13.1. Each purchasing contract entered into between the Seller and the Buyer pursuant to these Conditions shall be governed by and construed in accordance with Italian Law and, in particular, for Consumers, in accordance with Italian Legislative Decree 6 September 2005 no. 2016 (the Italian Consumer Code), with specific reference to the provisions related to distance contracts and, also for the Professionals, in accordance with Italian Legislative Decree 9 April 2003 no. 70 regarding some aspects of the electronic commerce. In any case, the rights eventually attributed to the Consumers by mandatory provisions of laws, when applicable, are reserved.

13.2. In case of any disputes arising between the Seller and a Consumer, the Seller guarantees its participations to a friendly conciliation attempt which each Consumer may promote before “RisolviOnline”, an independent and institutional service provided by the Chamber of Arbitration of the Milan Chamber of Commerce, which consents to achieve a satisfactory agreement, with the help of a neutral and competent conciliator, in a friendly and safe manner on the web. For further information concerning the “RisolviOnline” regulation or in order to send a conciliation request, please visit www.risolvionline.com.

13.3. As an alternative to the conciliation attempt referred to in the preceding Clause 12.2, the Consumer, in order to resolve any dispute arising between the latter and the Seller, might also access the European Online Dispute Resolution platform (the European ODR Platform). The European ODR Platform has been developed and is managed by the European Commission, in accordance with Directive no. 2013/11/EU and Regulation EU no. 524/2013, in order to facilitate an independent, impartial, transparent, efficient, rapid and just resolution of out-of-court disputes relating to contractual obligations arising out of online sale or service contracts between a consumer residing in the European Union and a professional established within the EU, through the intervention of an ADR (“Alternative Dispute Resolution”) body, to be selected from a list available thereof. 13.4. In the event that the Consumer or the Seller does not adhere to one of the conciliation attempts referred to in clauses 12.2 or 12.3 above or such attempt has a negative outcome, the dispute shall be deferred to the jurisdiction of the Court where the Consumer has his or her residence or domicile.

13.5. In case of disputes arising between the Seller and a Professional, the same shall be deferred to the exclusive jurisdiction of the Courts of Milan.

13.6. This English translation is made only in order to facilitate the understanding of this Terms and Conditions. In the event of any discrepancy between the Italian version and this English translation, the Italian version shall always prevail.

1. Subject

1.1 These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "PZE Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”). The Buyer from a Third Party and the Voucher’s Beneficiary will be jointly referred to as the “User(s)”. The User will have received an univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).

1.2. Each PZE Package or Gift Voucher will entitle the User, who will be registered by using the Coupon Code through the dedicated web page of the site https://pzeroexperience.pirelli.com/en-gb/ (hereinafter respectively the “Web Page” and the “Site”) to participate, at the Silverstone Circuit (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the Car at the Circuit.

1.3. The PZE Packages and Gift Vouchers are sold by Pirelli UK Tyres Limited, with its registered office at Derby Road, Burton on Trent, DE13 0BH (hereinafter “PIRELLI”).

1.4. Any communication by the User, in connection with and/or in relation to the PZE Package and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeuk@pirelli.com (hereinafter the "Customer Service").

1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the Site via the internet, including any telephony costs incurred by the User with his/her service provider. 2. The PZE Package features and important rules for the access to the Circuit.

2.1. The PZE Package and the Gift Voucher are provided by PIRELLI with the features described on the Site and in accordance with these Conditions.

2.2. PIRELLI reserves the right to amend the agenda of the Event at any moment in time and as its own discretion

2.3. The PZE Packages and/or the characteristics of the same, are subject to change without notice and therefore, the Seller does not assume any responsibility in the event of changes in the contents of the PZE Package and/or program variations.

2.4. Access to the Circuit, following the procurement of a PZE Package, will only be allowed to Users: (i) whose vehicle features on the list of Cars published on the Site; and who (ii) hold a valid driving licence entitling them to drive such vehicles.

2.6. Access to the Circuit by each User is subject to:
(i)the unconditional acceptance and agreement by the User of the indemnity documents that the Seller and the car manufacturers will ask the User to sign, which can be seen here;
(ii) the acceptance and agreement to the PZE regulations (which incorporate any Circuit regulations, which can be seen here.

2.7. Access to the Circuit will not be allowed to people other than the Users, their registered Companions (if any), nor to cars other than the Cars and always in compliance with the PZE Regulations.
3. PZE Package and Gift Voucher registration procedure

3.1. Before proceeding with the registration using the Coupon Code, the User must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the list of Cars for compatibility with their vehicle and the documents referenced under section 2.3 from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.

3.2. On the Web Page, the User will be invited to provide his/her personal data and the details of the Car he/she will drive during the Event, as well as personal data of the Companion(s) if any, in order to complete the registration process for the attendance to the Event.

3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address each User provided to PIRELLI, during the registration process, of an email confirming that the registration has been successfully completed, which will contain a link to the text of these Conditions, the name of the natural person who is registered to use PZE Package or the Gift Voucher (both coinciding with the User), the names of the Companion(s) (if any), the day of the Event, the model and licence plate of the Car authorised to access the track and a description of the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and the User may request copies by sending an email to Customer Service.

3.4 The User cannot be changed after receipt of the Access Pass.

4. Delivery and use of the PZE Package and/or of the Gift Voucher

4.1. To be able to use the PZE Package or the Gift Voucher, as applicable, the User must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of clause 2.4 above.

4.3. If the User is absent on the day of the Event, the right to use the PZE Package or the Gift Voucher will be lost, without possibility of reimbursement.

5. Cancellation Communications 5.1 In the event that the User wishes to cancel his/her participation in the Event, the User must send an e-mail to Customer Service. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by the entity who sold the PZE Package to the Buyer from a Third Party.

6. Intellectual Property Rights

6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site/Web Page or relating to PZE Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the User in relation to the same as a result of access to the Site/Web Page and/or purchase of the PZE Packages or Gift Vouchers.

6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

7. Personal data and protection of privacy 7.1 To be able to proceed with the registration process of the User and any Companion(s), for the purpose of participating in the Event and based on these Conditions, some personal information of the User, of the Companions (if any), will be requested through the Web Page, as indicated in Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the registration process for the Event will be collected and used for the purposes indicated in the PIRELLI Privacy Policy.

7.2 The User hereby declares and guarantees that the data provided during the registration process are correct and true.

7.3. For any other information relating to the processing of the personal data of the User, the Companions (if any), please refer to the PIRELLI Privacy Policy.

8. Security

8.1. Although PIRELLI has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the information or data displayed by the User on the Site and/or the Web Page, will not be accessible or viewable by unauthorized third parties.

9. Applicable law and jurisdiction

9.1. These Conditions shall be governed by and construed in accordance with laws of England and Wales.

9.2. In case of any disputes arising between PIRELLI and the User the same shall be deferred to the exclusive jurisdiction of the Courts of England and Wales.

1. Subject

1.1. These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "P ZERO™ Experience Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”). The Buyer from a Third Party and the Voucher’s Beneficiary will be jointly referred to as the “User(s)”. The User will receive an univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).

1.2. Each P ZERO™ Experience Package or Gift Voucher will entitle the User, who will be registered by using the Coupon Code through the dedicated web page of the site https://pzeroexperience.pirelli.com/en-gb/ (hereinafter respectively the “Web Page” and the “Site”) to participate, at the Mugello Circuit (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the Car at the Circuit.

1.3. The Event is organized by Pirelli Tyre S.p.A, a joint stock company with a sole shareholder - management and coordination of Pirelli & C. S.p.A., with registered office in Viale Piero e Alberto Pirelli, 25 – 20126 Milan (Italy), Tax Code, VAT No. and Milan, Monza Brianza and Lodi Business Registry Enrolment No. 07211330159, R.E.A of Milan 1147607 (hereinafter “PIRELLI”).

1.4. Any communication by the User, in connection with and/or in relation to the P ZERO™ Experience Package and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeroexperienceitalia@pirelli.com (hereinafter the "Customer Service").

1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the Site via the internet, including any telephony costs incurred by the User with his/her service provider.

2. The P ZERO™ Experience Package and Gift Voucher features and important rules for the access to the Circuit.

2.1. The P ZERO™ Experiences Package and the Gift Voucher are provided by PIRELLI with the features described on the Site and in accordance with these Conditions.

2.2. PIRELLI reserves the right to amend the agenda of the Event at any moment in time and as its own discretion.

2.3. The possibility of accessing the Circuit will be allowed only to Users who:

(i) have completed the registration procedure on the Web Page using the Coupon Code, indicating any companions (the “Companions”) and/or the additional driver (“Additional Driver”), where applicable;

(ii) are legitimate owners/keepers of the Car(s);

(iii) are 21 of age or over and have a driving license in the course of validity, issued for at least 36 (thirty six) months and not subject to suspension or other sanctioning measures;

(iv) have unconditionally accepted and agreed to the Circuit regulations;

(v) have accepted and agreed to the P ZERO™ Experience regulations (inclusive of the Covid-19 Safety and Hygiene Measures) which will be provided by PIRELLI and which can be read and downloaded here;

(vi) have unconditionally accepted and agreed to the indemnity documents that the Circuit and PIRELLI will ask them to sign. Click here to read and download the indemnity documents of the Circuit and of PIRELLI.

2.4. The access to the Circuit will not be allowed to people other than the Users, their registered Companions and the Additional Driver (if any and where applicable), nor to cars other than the Cars and always in compliance with the P ZERO™ Experience Regulations. No other person out of the User and the Additional Driver (if any) will be permitted to drive the Car

3. P ZERO™ Experience Package and Gift Voucher registration procedure

3.1. Before proceeding with the registration using the Coupon Code, the User must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the list of Cars and the documents referenced under section 2.3 from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.

3.2. On the Web Page, the User will be invited to provide his/her personal data and the details of the Car he/she will drive during the Event, as well as personal data of the Companions and of the Additional Driver, if any and as applicable, in order to complete the registration process for the attendance to the Event.

3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address each User provided to PIRELLI, during the registration process, of an email confirming that the registration has been successfully completed, which will contain a link to the text of these Conditions, the name of the natural person who owns the P ZERO™ Experience Package or the Gift Voucher (both coinciding with the User), the names of the Companions (if any) and the name of the Additional Driver, if any and if applicable, the day of the Event, the model and licence plate of the Car authorised to access the track and a description of the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and the User may request copies by sending an email to Customer Service.

3.4. The User and the Additional Drive’s names (if any) cannot be changed after the receipt of the Access Pass.

4. Delivery and use of the P ZERO™ Experience Package and/or of the Gift Voucher

4.1. To be able to use the P ZERO™ Experience Package or the Gift Voucher, as applicable, the User must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of clause 2.4 above.

4.3. If the User is absent on the day of the Event, the right to use the P ZERO™ Experience Package or the Gift Voucher will be lost, without possibility of reimbursement.

5. Cancellation Communications

5.1. In the event that the User wishes to cancel his/her participation in the Event, the User has to send an e-mail to the Customer Service. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by the entity who has sold the P ZERO™ Experience Package to the Buyer from a Third Party.

6. Intellectual Property Rights

6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site/Web Page or relating to P ZERO™ Experience Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the User in relation to the same as a result of access to the Site/Web Page and/or purchase of the P ZERO™ Experience Packages or Gift Vouchers.

6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

7. Personal data and protection of privacy

7.1. To be able to proceed with the registration process of the User, Companions and Additional Driver, if any and as applicable, for the purpose of participating in the Event and based on these Conditions, some personal information of the User, of the Companions and of the Additional Driver if any and as applicable, will be requested through the Web Page, as indicated in Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the registration process for the Event will be collected and used for the purposes indicated in the PIRELLI Privacy Policy.

7.2. The User hereby declares and guarantees that the data provided during the registration process are correct and true.

7.3. For any other information relating to the processing of the personal data of the User, the Companions (if any) and the Additional Driver (if any), please refer to the PIRELLI Privacy Policy.

8. Security

8.1. Although PIRELLI has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the information or data displayed by the User on the Site and/or the Web Page, will not be accessible or viewable by unauthorized third parties.

9. Applicable law and jurisdiction

9.1 These Conditions shall be governed by and construed in accordance with Italian Law.

9.2. In case of any disputes arising between PIRELLI and the User the same shall be deferred to the exclusive jurisdiction of the Courts of Milan.

9.3. This English translation is made only in order to facilitate the understanding of these Conditions. In the event of any discrepancy between the Italian version and this English translation, the Italian version shall always prevail.

1. Subject matter

1.1. These General Terms and Conditions (hereinafter "GTC") apply to the purchase of the packages "P ZERO™ Experience Package" (hereinafter "P ZERO™ Experience Package") or the gift voucher for the "P ZERO™ Experience Package" (hereinafter the “Gift Voucher”) via the website https://pzeroexperience.pirelli.com/en-de/circuits/nürburgring (hereinafter "Website") by a "Consumer" or "Entrepreneur" within the meaning of the following section 1.2, which entitles the buyer and the Gift Voucher’s beneficiary (both as defined below) to take part in a track day on the circuit of the Nürburgring (hereinafter "Circuit") with their own car (the “Event”), subject to such car being on the list of approved vehicles published having the characteristics indicated on the Site (“Car(s)”).
Dates and relevant information available for the use of the P ZERO™ Experience Package and the Gift Voucher (as applicable) are published on the Website.

1.2. Each P ZERO™ Experience Package and the Gift Voucher are sold via the Website by Pirelli Deutschland GmbH with its registered office at Höchster Straße 48-60, 64747 Breuberg/Odw., Germany Commercial register HRB 71623, value added tax DE111607952, (hereinafter "PIRELLI").
The parties involved in the purchase of the P ZERO™ Experience Package and the Gift Voucher are PIRELLI as seller (hereinafter referred to as the "Seller") and those parties for whom the purchase of the P ZERO™ Experience Package does not form part of the operations of its company / business activities in accordance with § 13 of the German Civil Code (BGB) (hereinafter referred to as the "Consumer") or for which the purchase forms part of the operations of its company / business activities in accordance with § 14 BGB (hereinafter referred to as the "Entrepreneur") as buyer (Consumers and Entrepreneurs are individually referred to as the "Buyer" and collectively as the "Buyers"). The Seller and the Buyer shall, where applicable, be collectively referred to as the "Parties".

Pursuant to the Conditions, the people whose details are registered as the Buyer, the Additional Driver (if any) or the Voucher’s Beneficiary (if applicable), as defined below in section 2.5, during the purchase procedure of the P ZERO™ Experience Package and/or the Gift Voucher, are the people, who will be the only persons entitled to drive the Car at the Circuit.

1.3. Any contact by the Buyer in connection with and/or in relation to the purchase of the PZERO™ Experience Package, including, but not limited to, any notification, demand or enquiry regarding the purchase and/or delivery of the PZERO™ Experience Package, etc. shall be made to the addresses specified on the Website in accordance with the methods described therein or to the email address pzeroexperience.germany@pirelli.com (hereinafter referred to as "Customer Service").

1.4 All purchases are subject to the GTC published on the Website at the time the Buyer places the order.

1.5. If one or more sales are made to an Entrepreneur, they are subject to these GTC whereby and notwithstanding the provisions of the same:
a) any protections that mirror or satisfy mandatory statutory provisions in favour of Consumers shall not apply;
b) in the event of a dispute between the Seller and an Entrepreneur, sections 13.2 - 13.4 of the GTC relating to disputes between the Seller and a consumer shall not apply.

1.6 By submitting the order, the Buyer agrees that the confirmation of the details of the order placed and these GTC will be sent by email to the email address provided when registering on the Website or during the purchase transaction.

1.7 Buyers must be at least 21 years of age and have sufficient legal capacity to purchase one or more P ZERO™ Experience Packages on the Website. The Buyer, who wants to purchase only the Gift Voucher on the Website can be 18 years of age or over but the Voucher’s Beneficiary must be aged 21 or over. In both cases, the Buyer of the P ZERO™ Experience Package or the Gift Voucher must have legal capacity.

1.8. The Buyer shall bear all costs incurred in connection with the Website via the Internet, including all telephone costs incurred by the Buyer from its service provider.

2. Characteristics of the P ZERO™ Experience Package and the Gift Voucher; important rules for accessing the Circuit

2.1. Each PZERO™ Experience Package and the Gift Voucher are sold by the Seller with the characteristics described on the Website and in accordance with the terms and conditions published on the Website at the time the Buyer places the order, to the exclusion of any other terms and conditions.

2.2. The Seller reserves the right to amend these GTC, in whole or in part, at any time and at its sole discretion, without notice to the users of the Website. All changes take effect on the day they are published on the Website and only apply to orders placed from this date.

2.3. The selling price and/or characteristics of the PZERO™ Experience Package and the Gift Voucher offered on the Website are subject to change without notice and therefore the Seller accepts no liability in the event of changes to the contents of the PZERO^TM Experience Package, Gift Voucher and/or the programme. Such changes only apply to orders placed thereafter. The Buyer is always recommended to check the final purchase price before placing the order in accordance with section 3 (see below).

2.4. The Website is accessible to users from all over the world; however, the P ZERO™ Experience Package offered on the Website can only be purchased by users who request the provision of the services provided for in the P ZERO™ Experience Package in Germany.

2.5. During the purchase procedure of the P ZERO™ Experience Package, the Buyer will have the choice to select one (1) additional driver (the “Additional Driver”), or the option to purchase a Gift Voucher selecting the P ZERO™ Experience Package for a third party, natural person (hereinafter the "Voucher’s Beneficiary“).

2.6. Access to the Circuit after the purchase of the P ZERO™ Experience Package or a Gift Voucher is only granted to Buyers who
(i) are lawful owners or proprietors of the Cars;
(ii) are aged 21 or over;
(iii) have a valid driving license that has been issued for at least 36 (thirty six) months;
+ (iv)are not subject to a suspension or other sanctioning measures with respect to their driving license or driving a car.

No access to the Circuit itself will be granted to persons other than Buyers, the Additional Driver or the Voucher’s Beneficiary or vehicles other than the Car(s).
Companions will be entitled to attend the Event, according to the P ZERO™ Experience regulations.

2.7. The Buyer/driver, Additional Driver and/or the Voucher’s Beneficiary(as applicable) is granted access to the Circuit under the condition that they have read and unconditionally accepted:
i. the P ZERO™ Experience Regulations, which can be viewed here;
ii. the Indemnity Documents that the Circuit and the Seller will ask them to sign, which can be viewed here.

3. Purchase of the P ZERO™ Experience Package and/or the Gift Voucher – conclusion of each individual purchase contract

3.1 Any order submitted to the Seller by the Buyer via the Website constitutes a contractual offer and is subject to these GTC, which form an integral part of the order and which the Buyer fully accepts without reservation by placing the order. Before proceeding with the purchase of the P ZERO^TM Experience Package or a Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept the GTC and the documents referred to in section 2.7 online and either print a copy thereof by clicking on the "Print" function on his computer or save and retain a copy thereof for his own records. Companions who are not drivers can also fill in the documents on-site and sign them there. In this case, however, the Buyer must check the above rules in advance, so that the Buyer can ensure that the persons they may take on-site also meet the necessary requirements.

3.2. Acceptance of the Buyer's order (and the accompanying relevant payment as further detailed in Clause 7) shall be effected by the Seller sending an order confirmation (“Order Confirmation”) to the email address provided to the Seller by the Buyer prior to the confirmation of the purchase. The Order Confirmation shall include a link to the text of these GTC, the documents referred to in section 2.7, a summary of the order placed, including detailed price information, and

i. in case of a P ZERO™ Experience purchase, a description of the P ZERO™ Experience Package ordered together with a univocal alphanumeric code and details of the Buyer and the Additional Driver (if any), the day of the Event, the number and name of Companions (as defined in Clause 4.1), if any, and the model and license plate of the Car authorized to access the track (the e-mail is referred to as the “Access Pass”);

ii. in case of a Gift Voucher purchase, the day of the Event, the name of the Buyer, the name and e-mail address of the Voucher’s Beneficiary (if applicable), the number of Companions (if any). In this case, the email confirmation will also contain a univocal coupon code (the “Coupon Code”) and all the steps to be followed in order to receive the Access Pass. The Voucher’s Beneficiary will be requested to enter into an agreement with the Seller in which he/she will be subject to the provisions of Clause 2.6 and 2.7.

3.3. The Buyer's order, the Seller's Order Confirmation and the Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.

4. Selection and purchase of the P ZERO&tade; Experience Package and the Gift Voucher

4.1 The P ZERO™ Experience Package and Gift Voucher offered on the Website can be purchased by the Buyer by selecting the P ZERO^TM Experience Package and/or the Gift Voucher of interest and placing it in the virtual shopping cart. One (1) P ZERO™ Experience Package and/or one (1) Gift Voucher may be purchased per order.
Every P ZERO™ Experience Package purchased must include the Buyer and optionally (at an additional cost as detailed on the Website) one (1) Additional Driver and up to three (3) companions (the latter hereinafter referred to as "Companions")) in accordance with the P ZERO™ Experience Regulations.
In case the Buyer wishes to purchase a Gift Voucher, the Gift Voucher can optionally include (at an additional cost as detailed on the Site) up to three (3) Companions, in compliance with the P ZERO™ Experience regulations. Before the Buyer can place an order, he must pre-register on the Pirelli websites intended for this purpose and provide the personal data required therein. The user then clicks on "anmelden" (register) and receives an email in which he clicks on "jetzt Anmeldung bestätigen” (confirm registration now). Clicking on the button in the email takes the Buyer to the landing page https://pzeroexperience.pirelli.com/en-de/circuits/nürburgring where he can select and purchase his P ZERO™ Experience Package.

4.2. The name of the Buyer, the Additional Driver (if any) and the Voucher’s Beneficiary cannot be changed after the purchase procedure and no other person will be permitted to drive the Car registered by the Buyer or by the Voucher’s Beneficiary, as applicable.

4.3. After having selected the P ZERO™ Experience Package or the Gift Voucher, to complete the purchase of the P ZERO™ Experience Package or the Gift Voucher (as applicable) in its basket, the Buyer will be invited to provide his/her personal data as well as the personal data of the Additional Driver and of the Companions (if any), or the personal data and e-mail of the Voucher’s Beneficiary and of the Companions (if any) in order to complete the order and enable the contract to be finalised.
The Buyer will see a summary of the order to be processed, containing the information detailed in Clause 3.2., having read them carefully, the Buyer must then expressly approve these Conditions and the documents indicated in paragraphs Clauses 2.7, by checking the appropriate box (check-box) on the Site and finally the Buyer will be asked to confirm his order with the "PURCHASE" button and submit payment in accordance with Clause 7 below. The order will then be sent to the Seller and will produce the effects described in the above Clause 3.2.

5. Delivery and use of the P ZERO™ Experience Package

5.1. In order to use the P ZERO™ Experience Package or the Gift Voucer, as applicable, the Buyer or the Voucher’s Beneficiary must present the Access Pass at the entrance to the Circuit on the day of the Event and comply with sections 2.6 and 2.7 of these GTC.

5.2. Should the Buyer or the Voucher’s Beneficiary be absent on the day of the Event, the right to use the P ZERO™ Experience Package expires without the option of a refund.

Price

6.1. The price of the P ZERO™ Experience Package and the Gift Voucher correspond to the prices displayed on the Website at the time the Buyer places the order. Prices include value added tax, as applicable (currently 19%).

6.2. The prices of the P ZERO™ Experience Package and of the Gift Voucher do not include costs for accommodation and meals, travel to and from the Circuit, or other costs not expressly specified.

6.3. The Buyer shall pay the Seller the full price as stated in the order and confirmed in the Order Confirmation sent by the Seller to the Buyer by email. In the event of a discrepancy between the price stated in the order and the price stated in the order confirmation, the price stated in the order shall apply.

7. Payment

7.1 Payment of the price of the P ZERO™ Experience Package and/or the Gift Voucher purchased through the Website must be made at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly agrees that performance of the Contract by the Seller shall only commence after crediting the purchase price for the purchased P ZERO™ Experience Package and/or the Gift Voucher to the Seller's current account.

7.2. Payment must be made by credit card or PayPal and the Buyer will therefore be required to provide the relevant information through a protected connection. For accounting and administration purposes, the Seller reserves the right to check the personal information provided by the Buyer. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.

7.3. During the payment process, the Buyer is forwarded to a protected website to the operator providing acquiring services to the Seller. The transmitted data is sent in protected mode by encrypting the information with a 128-bit or higher SSL (SecureSocketLayer) system. Not even the Seller can access this information.

7.4. The Seller shall immediately send the Buyer the tax receipt in electronic format for the purchase made or, on request, an electronic invoice to the email address provided by the Buyer.

8. Cancellation - refund conditions

8.1. PIRELLI reserves the right to cancel the Event for organisational, safety or weather related reasons, due to orders from authorities, or if the Circuit is no longer available and/or for reasons of force majeure (including an epidemic or pandemic). In this case, the Buyer is not entitled to a refund of the amount paid. This clause does not affect the provisions of section 8.3 and 8.4, which provides for a right of refund on cancellation as specified.

8.2 Should the Buyer or the Additional Driver or the Voucher’s Beneficiary be prevented from attending the Event due to orders from local or national authorities (e.g. bans or border closures), the Buyer is entitled to choose between a full refund or a voucher to take part in a P ZERO™ Experience that will be held in Europe during 2022. Any other refund is expressly excluded.

8.3. In the event that the Buyer or the Voucher’s Beneficiary (as applicable) wishes to cancel his taking part in the Event, the Buyer is entitled to a refund as follows:
Cancellation 30 days or more before the date of the Event: 100% refund
Cancellation between 14 and 29 days before the date of the Event: 50% refund
Cancellation 13 days or less before the date of the Event: no refund

8.4. Cancellation must be made by the Buyer (before a Voucher’s Beneficiary receives the Access Pass) or by the Voucher’s Beneficiary (after the Voucher’s Beneficiary receives the Access Pass) by sending an email to Customer Services.
If the Buyer is entitled to a refund, the Seller shall refund the corresponding amount without undue delay and in any case no later than 14 days after notification of the cancellation, with the exception of cases of delays that are not attributable to Seller. The Seller shall make such a refund using the same means of payment as the Buyer used to purchase the P ZERO™ Experience Package or the Gift Voucher.

9. Exclusion of the right of withdrawal – exclusion of liability

9.1. According to § 312g (2) lit. 9 BGB, the Buyer has no right of withdrawal/revocation.

9.2. The Seller has no liability for (i) non-receipt by the Buyer or by the Voucher’s Beneficiary of the documentation on the P ZERO™ Experience Package or the Gift Voucher acquired, or due to (ii) non - or partial - utilisation of the P ZERO™ Experience Package or of the Gift Voucher due to incorrect information provided by the Buyer (for example, incorrect e-mail address, incorrect specification of the model and/or licence plate of the vehicle or information regarding the Buyer and/or the Voucher’s Beneficiary) or (iii) due to cancellation of the event to which the P ZERO™ Experience Package acquired pertains for reasons not imputable to the Seller.

10. Intellectual property rights

10.1. The Buyer acknowledges that he is aware that Pirelli & C. S.p.A., Pirelli Tyre S.p.A or, as the case may be, their respective owners (collectively and individually, the "Owners") have exclusive rights of use over all trademarks, names and other marks, including, but not limited to, the "PIRELLI" word and figurative mark and logo trademark, the "P ZERO™" trademark, as well as any images, photos, written texts or graphics used on the Website or relating to the P ZERO™ Experience Package, without the Buyer having any rights in this regard from accessing the Website and/or purchasing the P ZERO™ Experience Package or Gift Voucher.

10.2. The Website's content may not be reproduced, transmitted, modified or used for any purpose, in whole or in part, by electronic or conventional means, without the prior express written consent of the Owners.

11. Buyer's personal data and privacy 11.1. In order to process the order and conclude the contract on the basis of these GTC, some of the Buyer's (and/or of the Additional Driver’s, of the Companions and/or of the Voucher’s Beneficiary’s, as applicable) personal data is requested via the Website, as specified in sections 4.3 and 7. The Buyer acknowledges that the personal data he has provided for the purpose of the purchase will be collected and used for the purposes stated in the Privacy Policy.

11.2. The Buyer represents and warrants that the data provided during the registration and purchase process is true and accurate.

11.3. Further information on how the Buyer's personal data is processed can be found in the Privacy Policy.

12. Safety

12.1 Although the Seller has taken measures to protect personal data from loss, falsification, handling and misuse by third parties, the Seller cannot guarantee that the information or data entered by the Buyer on the Website, even after the Buyer has authenticated access (login), will not be accessible or visible to unauthorised third parties due to the technical features and restrictions on the protection of electronic communication via the internet.

12.2. With regard to credit card and Paypal payments, the Seller uses technical systems to ensure the highest level of reliability, security, protection and confidentiality when transferring information over the internet.

13. Applicable law, arbitration and jurisdiction

13.1. Any purchase agreement concluded between the Seller and the Buyer on the basis of these GTC is subject to German law, and, in particular for Consumers, in accordance with the German consumer protection laws, in particular the provisions applicable to consumer contracts. Any rights which may be attributed to Consumers through mandatory statutory provisions are reserved.

13.2. The mandatory German rules for electronic commerce apply.

13.3. The Consumer can access the European Online Dispute Resolution Platform (European ODR Platform) to resolve disputes between himself and the Seller. The European ODR Platform has been developed and is managed by the European Commission in accordance with Directive 2013/11/EU and Regulation EU 524/2013 to facilitate an independent, impartial, transparent, efficient, fast and equitable resolution of out-of-court disputes relating to contractual obligations arising from online purchase or service contracts between a Consumer established in the EU and a Entrepreneur established in the EU through the involvement of an ADR body ("Alternative Dispute Resolution") to be selected from an available list of the same. For more details on the European Union's ODR platform or to initiate an ADR procedure in relation to a purchase agreement concluded between the Seller and the Consumer on the ODR platform, please visit http://ec.europa.eu/odr. The Seller's electronic email address which would need to be provided on the EU ODR platform is pzeroexperience.germany@pirelli.com.

13.4. In the event that the Consumer or Seller does not take part in any of the arbitration attempts referred to in the preceding sections 13.3 or such an attempt results in a negative outcome, the dispute shall fall within the jurisdiction of the court in whose jurisdiction the Consumer resides or at the discretion of the Consumer in whose jurisdiction the Seller has his registered office.

13.5. Disputes between the Seller and a Entrepreneur fall under the exclusive jurisdiction of the courts in Frankfurt am Main.

13.6. This English translation is made only in order to facilitate the understanding of this Terms and Conditions. In the event of any discrepancy between the German version and this English translation, the German version shall always prevail.

1. Subject

1.1. These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "P ZERO™ Experience Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”). The Buyer from a Third Party and the Voucher’s Beneficiary will be jointly referred to as the “User(s)”. The User will receive an univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).

1.2. Each P ZERO™ Experience Package or Gift Voucher will entitle the User, who will be registered by using the Coupon Code through the dedicated web page of the site https://pzeroexperience.pirelli.com/en-gb/ (hereinafter respectively the “Web Page” and the “Site”) to participate, at the Nürburgring (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the Car at the Circuit.

1.3. The Event is organized by Pirelli Deutschland GmbH, with its registered office at Höchster Straße 48-60, 64747 Breuberg/Odw., Germany Commercial register HRB 71623, value added tax DE111607952 (hereinafter “PIRELLI”).

1.4 Any communication by the User, in connection with and/or in relation to the P ZERO™ Experience Package and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeroexperience.germany@pirelli.com (hereinafter the "Customer Service").

1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the Site via the internet, including any telephony costs incurred by the User with his/her service provider.

2. The P ZERO™ Experience Package and Gift Voucher features and important rules for the access to the Circuit.

2.1. The P ZERO™ Experiences Package and the Gift Voucher are provided by PIRELLI with the features described on the Site and in accordance with these Conditions.

2.2. PIRELLI reserves the right to amend the agenda of the Event at any moment in time and as its own discretion.

2.3. The possibility of accessing the Circuit will be allowed only to Users who:
(i) have completed the registration procedure on the Web Page using the Coupon Code, indicating any companions (the “Companions”) and/or the additional driver (“Additional Driver”), where applicable;
(ii) are legitimate owners/keepers of the Car(s);
(iii) are 21 of age or over and have a driving license in the course of validity, issued for at least 36 (thirty six) months and not subject to suspension or other sanctioning measures;
(iv) have unconditionally accepted and agreed to the Circuit regulations
(v) have accepted and agreed to the P ZERO™ Experience regulations (inclusive of the Covid-19 Safety and Hygiene Measures) which will be provided by PIRELLI and which can be read and downloaded here;
(vi) have unconditionally accepted and agreed to the indemnity documents that the Circuit and PIRELLI will ask them to sign. Click here to read and download the indemnity documents of the Circuit and of PIRELLI.
2.4. The access to the Circuit will not be allowed to people other than the Users, their registered Companions and the Additional Driver (if any and where applicable), nor to cars other than the Cars and always in compliance with the P ZERO™ Experience Regulations. No other person out of the User and the Additional Driver (if any) will be permitted to drive the Car

3. P ZERO™ Experience Package and Gift Voucher registration procedure

3.1 Before proceeding with the registration using the Coupon Code, the User must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the list of Cars and the documents referenced under section 2.3 from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.

3.2. On the Web Page, the User will be invited to provide his/her personal data and the details of the Car he/she will drive during the Event, as well as personal data of the Companions and of the Additional Driver, if any and as applicable, in order to complete the registration process for the attendance to the Event.

3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address each User provided to PIRELLI, during the registration process, of an email confirming that the registration has been successfully completed, which will contain a link to the text of these Conditions, the name of the natural person who owns the P ZERO™ Experience Package or the Gift Voucher (both coinciding with the User), the names of the Companions (if any) and the name of the Additional Driver, if any and if applicable, the day of the Event, the model and licence plate of the Car authorised to access the track and a description of the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and the User may request copies by sending an email to Customer Service.

3.4 The User and the Additional Drive’s names (if any) cannot be changed after the receipt of the Access Pass.

4. Delivery and use of the P ZERO^TM Experience Package and/or of the Gift Voucher

4.1 To be able to use the P ZERO™ Experience Package or the Gift Voucher, as applicable, the User must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of clause 2.4 above.

4.2. The name of the Buyer, the Additional Driver (if any) and the Voucher’s Beneficiary cannot be changed after the purchase procedure and no other person will be permitted to drive the Car registered by the Buyer or by the Voucher’s Beneficiary, as applicable.

4.3. If the User is absent on the day of the Event, the right to use the P ZERO^TM Experience Package or the Gift Voucher will be lost, without possibility of reimbursement.

5. Cancellation Communications

5.1. In the event that the User wishes to cancel his/her participation in the Event, the User has to send an e-mail to the Customer Service. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by the entity who has sold the P ZERO™ Experience Package to the Buyer from a Third Party.

6. Intellectual Property Rights

6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site/Web Page or relating to P ZERO™ Experience Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the User in relation to the same as a result of access to the Site/Web Page and/or purchase of the P ZERO™ Experience Packages or Gift Vouchers.

6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

7. Personal data and protection of privacy

7.1 To be able to proceed with the registration process of the User, Companions and Additional Driver, if any and as applicable, for the purpose of participating in the Event and based on these Conditions, some personal information of the User, of the Companions and of the Additional Driver if any and as applicable, will be requested through the Web Page, as indicated in Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the registration process for the Event will be collected and used for the purposes indicated in the PIRELLI Privacy Policy.

7.2. The User hereby declares and guarantees that the data provided during the registration process are correct and true.

7.3. For any other information relating to the processing of the personal data of the User, the Companions (if any) and the Additional Driver (if any), please refer to the PIRELLI Privacy Policy.

8. Security

8.1. Although PIRELLI has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the information or data displayed by the User on the Site and/or the Web Page, will not be accessible or viewable by unauthorized third parties.

9. Applicable law and jurisdiction

9.1. These Conditions shall be governed by and construed in accordance with German Law.

9.2. In case of any disputes arising between PIRELLI and the User the same shall be deferred to the exclusive jurisdiction of the Courts of Frankfurt am Main, Germany.

9.3. This English translation is made only in order to facilitate the understanding of these Conditions. In the event of any discrepancy between the German version and this English translation, the German version shall always prevail.

1. Subject

1.1 These general terms and conditions of sale (hereinafter the “Conditions”) shall apply to the purchase, by users falling within the definition of “Consumers” and of “Professionals” (as defined in clause 1.2 below), through the website https://pzeroexperience.pirelli.com/en-gb/circuits/donington (hereinafter the “Site”) of the package named “P ZERO™ Experience” (hereinafter the "PZE Package" or the "PZE Packages") or a gift voucher for the PZE Package (“Gift Voucher”) which will entitle the Buyer (as defined in clause 1.2 below) and the Voucher Beneficiary (defined in clause 2.5 below) to participate, at the MSV Donington Circuit (hereinafter the "Circuit") in a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”).

The dates available for the Event and the descriptions of the PZE Package are published on the Site.

1.2 The PZE Packages and Gift Vouchers are sold by Pirelli UK Tyres Limited, with its registered office at Derby Road, Burton on Trent, DE13 0BH (hereinafter, the "Seller").

The parties involved in the purchase of PZE Packages or Gift Vouchers (as applicable) via the Site shall be the Seller and the party who purchases the PZE Packages or Gift Vouchers (as applicable) either: (i) for reasons other than in relation to the profession, business, trade or craft conducted by that party or that of another party (hereinafter the "Consumer"); or (ii) in relation to the profession, business, trade or craft conducted by that party, (hereinafter the "Professional"); as the buyers (the Consumer and the Professional shall individually be referred to as the “Buyer” and jointly as the “Buyers”). The Seller and the Buyer, as the case may be, shall be referred to jointly as the "Parties".

During the purchasing procedure of the PZE Package or the Gift Voucher (as applicable) the Buyer will be required to enter the details of the person(s) who are to drive the Car at the Circuit. (“Driver”)

1.3 Any communication by the Buyer, in connection with and/or in relation to the purchase of a PZE Package or Gift Voucher (as applicable), including, but not limited to any notifications, claims or requests concerning the purchase and/or delivery of the PZE Package or Gift Voucher (as applicable), shall be made to the Seller at the addresses and in accordance with the methods indicated on the Site or to the email address pzeuk@pirelli.com (hereinafter the "Customer Service").

1.4. All purchases are regulated by the Conditions, as published on the Site at the time the order is submitted by the Buyer.

1.5. If one or more sales are made to a Professional, the Conditions shall apply but, notwithstanding the provisions of the same:
a) the Professional will not be recognised by any other protections provided herein in favour of Consumers, which reflect or comply with mandatory provisions of law;
b) for disputes between the Seller and a Professional, clause 12.4 of the Conditions, referring to disputes between the Seller and a Consumer shall not apply.

1.6. Buyers must be aged 18 or over in order to make purchases of PZE Packages or Gift Vouchers on the Site and to access the Circuit and participate in such events.

1.7. The Buyer shall be responsible for any costs incurred to connect to the Site via the internet, including any telephony costs incurred by the Buyer with their service provider.

2. Features and important rules for the access to the Circuit

2.1. The PZEs Packages and Gift Vouchers are sold by the Seller with the features and in accordance with the Conditions published on the Site at the time the order is sent by the Buyer, with the exclusion of any other terms or conditions.

2.2. The Seller reserves the right to amend all or part of the Conditions, at any moment in time, and at its own discretion without giving any notice to users of the Site. Any amendments made shall come into force from the date on which they are published on the Site and will only apply to orders placed from that date onwards.

2.3. Sale prices, the PZE Packages and Gift Vouchers sold on the Site and/or the characteristics of the same, are subject to change without notice and therefore, the Seller does not assume any responsibility in the event of changes in the contents of the PZE Package, Gift Voucher and/or program variations. Such changes shall only apply to orders placed after the date of such changes being implemented. In any case, the Buyer

2.4. Users from all over the world may access the Site; however, the PZE Package and Gift Vouchers available on the Site should only be purchased by users who wish to participate in such event in the UK at the Circuit. During the purchasing procedure, the Buyer will have the option to purchase a Gift Voucher for a third party, natural person (“Voucher Beneficiary”).

2.5 Access to the Circuit, following the purchase of a PZE Package or Gift Voucher, will only be allowed to the Buyer or Voucher Beneficiary (as applicable): (i) whose vehicle features on the list of Cars published on the Site; and who (ii) hold a valid driving licence entitling them to drive such vehicles. A Companion will be entitled to attend the Event in accordance with the PZE Regulations (defined in clause 2.6(ii) below).

2.6 Access to the Circuit by each Buyer or Voucher Beneficiary is subject to:
(i) the unconditional acceptance and agreement by the Buyer or Voucher Beneficiary (as applicable) of the indemnity documents that the Seller and the car manufacturers will ask the Buyer or Voucher Beneficiary (as applicable) to sign, which can be seen here;
(ii) the acceptance and agreement to the PZE regulations (which incorporate any Circuit regulations), which can be seen here (“PZE Regulations”).

3. Conclusion of each individual purchase contract

3.1. Each order submitted by the Buyer to the Seller via the Site has the value of a contractual proposal and is subject to the Conditions which form an integral part of the order and which the Buyer, by placing the order, fully accepts without any reservation. Before proceeding with the purchase of the PZE Package or Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept (and print and/or save copies, for their records of) the Conditions together with the documents detailed in clause 2.6.

3.2. A contract is formed when the Buyer's order (accompanied by the relevant payment as further detailed in clause 7) is accepted by the Seller by sending to the Buyer (at the e-mail address provided by the Buyer during the purchase procedure) an e-mail confirming that the order has been accepted ("Order Confirmation"). This email confirmation will contain a link to the text of the Conditions, a summary of the order placed (including detailed price information and date), and a description of the PZE Package ordered together with a pdf attachment containing the unique alphanumeric code and details of the Driver, the name of the Buyer’s accompanying person (if any), and the model and licence plate of the Car participating at the Circuit (hereinafter, the “Pass”). Voucher Beneficiaries will be subject to the provisions of clause 2.5 and 2.6 of the Conditions and may be required to enter into an agreement with the Seller in respect thereof.

3.3. The Buyer's order, the Order Confirmation and the Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.

4. Selection and purchasing procedure

4.1. The PZE Packages and Gift Vouchers presented on the Site can be purchased by the Buyer's selecting the PZE Package or Gift Voucher of interest and placing it in the virtual purchase basket. One (1) PZE Package and/or one (1) Gift Voucher may be purchased with each order. Each PZE Package purchased must include the Buyer and optionally, one additional accompanying person (at an additional cost as detailed on the Site). For each Gift Voucher purchase, the Buyer can optionally include up to one (1) Companion, in compliance with the PZE Regulations. The name of the Buyer or Voucher Beneficiary (as applicable) cannot be changed after the purchase and no other persons will be permitted to drive the Car at the Circuit.

4.2 After having selected the PZE Package or Gift Voucher the Buyer will be invited to provide his/her personal data or that of the Voucher Beneficiary (as applicable) and any Companion in order to complete the order and purchase of the PZE Package or Gift Voucher in their basket and enable the contract to be finalised. The Buyer will see a summary of the order to be processed, containing the information detailed in clause 3.2 above. Having read them carefully, the Buyer must then expressly approve the Conditions and the documents referenced under clause 2.6, by checking the appropriate boxes (check-box) on the Site and finally, the Buyer will be asked to confirm his/her order with the "PURCHASE" button and submit payment in accordance with clause 7 below. The order will then be sent to the Seller and an Order Confirmation issued, as detailed in clause 3.2 above.

5. Delivery and use of the PZE Package and/or Gift Voucher

5.1 To be able to use the PZE Package or Gift Voucher, the Buyer or Voucher Beneficiary (as applicable) must show the Pass (as defined in clause 3.2 above) at the entry to the Circuit on the day of the Event, and comply with the provisions of clauses 2.5 and 2.6 above.

5.2 If the Buyer or Voucher Beneficiary (as applicable) is absent on the day of the Event, the right to use the PZE Package or Gift Voucher (as applicable) will be lost, without the possibility of reimbursement.

6. Prices

6.1. The price of a PZE Package and Gift Voucher is as indicated on the Site at the time the Buyer sends the order. Prices include VAT.

6.2. For the avoidance of doubt, the prices on the Site do not include the costs of any accommodation, travel to and/or from the Circuit, or any costs not expressly specified.

7. Payment

7.1. Payment of the price of the PZE Package and/or Gift Voucher purchased through the Site will be taken by the Seller at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly accepts that execution of the contract by the Seller will only start after the price of the PZE Package or Gift Voucher purchased is credited to the current account of the Seller.

7.2. Payment must be made by credit or debit card or by Paypal, and the Buyer will therefore be required to provide the relevant information through a protected connection. For accounting and administration purposes, the Seller reserves the right to check the personal information provided by the Buyer. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.

7.3. During the payment procedure, the Buyer will be transferred on a protected site to the operator that provides acquiring services for the Seller. The data transmitted will be sent in protected mode, by encrypting the information with a 128 bit or higher SSL (SecureSocketLayer) system. The Seller cannot access this information.

7.4. The Seller will promptly transmit to the Buyer, in electronic format to the e-mail address provided by the Buyer, the VAT receipt for the purchase made.

8. Cancellation - Refund

8.1. The Seller will not be liable to the Buyer for failure to perform any of its obligations to the extent that the failure is caused by a force majeure event (meaning any cause beyond the Seller’s reasonable control including without limitation, acts of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments or any epidemic or pandemic). In the event of imposition of governmental restrictions (for example reference mobility or the ability to hold such events), the Seller shall offer an alternative date (if possible) or provide a full refund to the Buyer, at the Buyer’s discretion. This clause does not affect the terms of clause 8.2 below, specifically providing for a right of refund in any other circumstances.  

8.2. In the event that the Buyer wishes to cancel his/her participation in the PZE Package or a purchased Gift Voucher, the Buyer’s entitlement to any refund will be as follows:
- cancellation 30 days or more prior to the date of the PZE Package: 100% refund
- cancellation between 14 to 29 days prior to the date of the PZE Package: 50% refund
- cancellation of 13 days or less prior to the date of the PZE Package: no refund

8.3 Any cancellations must be communicated to the Seller by sending an e-mail to Customer Service. In case the Buyer is entitled to a refund, the Seller shall refund the relevant amount without undue delay. The Seller will make such refund using the same means of payment (credit/debit card or Paypal) used by the Buyer for purchase of the PZE Package or Gift Voucher (as applicable). The Buyer will receive, within 7 days from his/her communication of cancellation, an email from Seller informing that the authorisation to the refund has been transmitted to the payment circuit used by the Buyer for the purchase. The effective time of refund will depend on such payment circuit and no responsibility will be attributable to the Seller for the effective time refund.

8.4. The Seller shall not be liable for occasions where the Buyer or Voucher Beneficiary is unable to access the Circuit due to: (i) non-receipt of the order documentation containing the requested information; or (ii) incorrect information provided by the Buyer (for example, incorrect e-mail address, incorrect specification of the model and/or licence plate of the Car to be used on the Circuit or incorrect information regarding the Buyer or Voucher Beneficiary).

9. Intellectual Property Rights

9.1. The Buyer acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site or relating to PZE Packages or Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., Pirelli Tyre S.p.A. or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the Buyer in relation to the same as a result of access to the Site and/or purchase of the PZE Packages or Gift Vouchers.

9.2. . Unless prior specific consent is granted in writing by the Owners, no contents of the Site can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

10. Personal data of the Buyer and protection of privacy

10.1. To be able to proceed to process the order and conclude the contract based on the Conditions, some personal information of the Buyer and/or the Voucher Beneficiary (as applicable) will be requested through the Site, as indicated in clauses 7 and 8. The Buyer acknowledges that the personal data he/she provides for the purpose of the purchase will be collected and used for the purposes indicated in the Seller's Privacy Policy. The Buyer acknowledges that the Seller's Privacy Policy regarding the processing of personal data for the purposes of the PZE Packages or Gift Vouchers can be accessed through the Site.

10.2. The Buyer declares and guarantees that the data provided during the purchasing process are correct and true.

11. Security

11.1. Although the Seller has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, the Seller cannot guarantee that the information or data input by the Buyer on the Site, even after the Buyer has authenticated access (login), will not be accessible or viewable by unauthorized third parties.

11.2. With regard to card and Paypal payments, the Seller adopts technological systems to guarantee the highest levels of reliability, security, protection and confidentiality in the transmission of information via the web.

12. Applicable law, conciliation and jurisdiction

12.1 Each purchasing contract entered into between the Seller and the Buyer pursuant to the Conditions shall be governed by and construed in accordance with English Law and, in particular, for Consumers, in accordance with the Consumer Contract Regulation 2013, the Consumer Rights Act 2015 and, also for the Professionals, in accordance with the Supply of Goods and Services Act 1982. In any case, the rights attributed to the Consumers by mandatory provisions of laws, when applicable, are reserved.

12.2 In case of any queries or complaints regarding a purchase, please contact the Seller using the Customer Service contact details, quoting any order reference numbers.

12.3 If any dispute arises, the Seller shall use its reasonable endeavours to consult or negotiate in good faith and attempt to reach a just and equitable settlement satisfactory to the Buyer.

12.4 As an alternative to the conciliation attempt referred to in the preceding clauses, the Consumer, in order to resolve any dispute arising between the latter and the Seller, may also access the European Online Dispute Resolution platform (the European ODR Platform). The European ODR Platform has been developed and is managed by the European Commission, in accordance with Directive no. 2013/11/EU and Regulation EU no. 524/2013, in order to facilitate an independent, impartial, transparent, efficient, rapid and just resolution of out-of-court disputes relating to contractual obligations arising out of online sale or service contracts between a consumer residing in the European Union and a professional established within the EU, through the intervention of an ADR (“Alternative Dispute Resolution”) body, to be selected from a list available thereof. 12.5 In the event that the Consumer or the Seller does not adhere to one of the conciliation attempts referred to in clauses 12.3 or 12.4 above, or such attempt has a negative outcome, the dispute shall be deferred to the jurisdiction of the Courts of England or Wales.

12.6 In case of disputes arising between the Seller and a Professional, the same shall be deferred to the exclusive jurisdiction of the Courts of England and Wales.

1. Subject

1.1 These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "PZE Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”). The Buyer from a Third Party and the Voucher’s Beneficiary will be jointly referred to as the “User(s)”. The User will have received an univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).

1.2. Each PZE Package or Gift Voucher will entitle the User, who will be registered by using the Coupon Code through the dedicated web page of the site https://pzeroexperience.pirelli.com/en-gb/ (hereinafter respectively the “Web Page” and the “Site”) to participate, at the Silverstone Circuit (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the Car at the Circuit.

1.3. The PZE Packages and Gift Vouchers are sold by Pirelli UK Tyres Limited, with its registered office at Derby Road, Burton on Trent, DE13 0BH (hereinafter “PIRELLI”).

1.4. Any communication by the User, in connection with and/or in relation to the PZE Package and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeuk@pirelli.com (hereinafter the "Customer Service").

1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the Site via the internet, including any telephony costs incurred by the User with his/her service provider. 2. The PZE Package features and important rules for the access to the Circuit.

2.1. The PZE Package and the Gift Voucher are provided by PIRELLI with the features described on the Site and in accordance with these Conditions.

2.2. PIRELLI reserves the right to amend the agenda of the Event at any moment in time and as its own discretion

2.3. The PZE Packages and/or the characteristics of the same, are subject to change without notice and therefore, the Seller does not assume any responsibility in the event of changes in the contents of the PZE Package and/or program variations.

2.4. Access to the Circuit, following the procurement of a PZE Package, will only be allowed to Users: (i) whose vehicle features on the list of Cars published on the Site; and who (ii) hold a valid driving licence entitling them to drive such vehicles.

2.6. Access to the Circuit by each User is subject to:
(i)the unconditional acceptance and agreement by the User of the indemnity documents that the Seller and the car manufacturers will ask the User to sign, which can be seen here;
(ii) the acceptance and agreement to the PZE regulations (which incorporate any Circuit regulations, which can be seen here.

2.7. Access to the Circuit will not be allowed to people other than the Users, their registered Companions (if any), nor to cars other than the Cars and always in compliance with the PZE Regulations.

3. PZE Package and Gift Voucher registration procedure

3.1. Before proceeding with the registration using the Coupon Code, the User must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the list of Cars for compatibility with their vehicle and the documents referenced under section 2.3 from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.

3.2. On the Web Page, the User will be invited to provide his/her personal data and the details of the Car he/she will drive during the Event, as well as personal data of the Companion(s) if any, in order to complete the registration process for the attendance to the Event.

3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address each User provided to PIRELLI, during the registration process, of an email confirming that the registration has been successfully completed, which will contain a link to the text of these Conditions, the name of the natural person who is registered to use PZE Package or the Gift Voucher (both coinciding with the User), the names of the Companion(s) (if any), the day of the Event, the model and licence plate of the Car authorised to access the track and a description of the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and the User may request copies by sending an email to Customer Service.

3.4 The User cannot be changed after receipt of the Access Pass. 4. Delivery and use of the PZE Package and/or of the Gift Voucher

4.1. To be able to use the PZE Package or the Gift Voucher, as applicable, the User must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of clause 2.4 above.

4.3. If the User is absent on the day of the Event, the right to use the PZE Package or the Gift Voucher will be lost, without possibility of reimbursement.

5. Cancellation Communications 5.1 In the event that the User wishes to cancel his/her participation in the Event, the User must send an e-mail to Customer Service. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by the entity who sold the PZE Package to the Buyer from a Third Party.

6. Intellectual Property Rights

6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site/Web Page or relating to PZE Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the User in relation to the same as a result of access to the Site/Web Page and/or purchase of the PZE Packages or Gift Vouchers.

6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

7. Personal data and protection of privacy 7.1 To be able to proceed with the registration process of the User and any Companion(s), for the purpose of participating in the Event and based on these Conditions, some personal information of the User, of the Companions (if any), will be requested through the Web Page, as indicated in Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the registration process for the Event will be collected and used for the purposes indicated in the PIRELLI Privacy Policy.

7.2 The User hereby declares and guarantees that the data provided during the registration process are correct and true.

7.3. For any other information relating to the processing of the personal data of the User, the Companions (if any), please refer to the PIRELLI Privacy Policy.

8. Security

8.1. Although PIRELLI has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the information or data displayed by the User on the Site and/or the Web Page, will not be accessible or viewable by unauthorized third parties.

9. Applicable law and jurisdiction

9.1. These Conditions shall be governed by and construed in accordance with laws of England and Wales.

9.2. In case of any disputes arising between PIRELLI and the User the same shall be deferred to the exclusive jurisdiction of the Courts of England and Wales.

1. Subject matter

1.1. These General Terms and Conditions (hereinafter "GTC") apply to the purchase of the packages "P ZERO^TM Experience Package" (hereinafter "P ZERO^TM Experience Package") or the gift voucher for the "P ZERO^TM Experience Package" (hereinafter the “Gift Voucher”) via the website https://pzeroexperience.pirelli.com/en-de/circuits/redbullring (hereinafter "Website") by a "Consumer" or "Entrepreneur" within the meaning of the following section 1.2, which entitles the buyer and the Gift Voucher’s beneficiary (both as defined below) to take part in a track day on the circuit of the Nürburgring (hereinafter "Circuit") with their own car (the “Event”), subject to such car being on the list of approved vehicles published having the characteristics indicated on the Site (“Car(s)”).
Dates and relevant information available for the use of the P ZERO™ Experience Package and the Gift Voucher (as applicable) are published on the Website.

1.2. Each P ZERO^TM Experience Package and the Gift Voucher are sold via the Website by Pirelli GmbH with its registered office at Lemböckgasse 47A, 1230 Wien, Austria, Vat No: ATU14205803 (hereinafter "PIRELLI").
The parties involved in the purchase of the P ZERO^TM Experience Package and the Gift Voucher are PIRELLI as seller (hereinafter referred to as the "Seller") and those parties for whom the purchase of the P ZERO^TM Experience Package does not form part of the operations of its company / business activities in accordance with § 13 of the German Civil Code (BGB) (hereinafter referred to as the "Consumer") or for which the purchase forms part of the operations of its company / business activities in accordance with § 14 BGB (hereinafter referred to as the "Entrepreneur") as buyer (Consumers and Entrepreneurs are individually referred to as the "Buyer" and collectively as the "Buyers"). The Seller and the Buyer shall, where applicable, be collectively referred to as the "Parties".

Pursuant to the Conditions, the people whose details are registered as the Buyer, the Additional Driver (if any) or the Voucher’s Beneficiary (if applicable), as defined below in section 2.5, during the purchase procedure of the P ZERO^TM Experience Package and/or the Gift Voucher, are the people, who will be the only persons entitled to drive the Car at the Circuit.

1.3. Any contact by the Buyer in connection with and/or in relation to the purchase of the PZERO^TM Experience Package, including, but not limited to, any notification, demand or enquiry regarding the purchase and/or delivery of the PZERO^TM Experience Package, etc. shall be made to the addresses specified on the Website in accordance with the methods described therein or to the email address pzeroexperience.centraleurope@pirelli.com (hereinafter referred to as "Customer Service").

1.4 All purchases are subject to the GTC published on the Website at the time the Buyer places the order.

1.5. If one or more sales are made to an Entrepreneur, they are subject to these GTC whereby and notwithstanding the provisions of the same:
a) any protections that mirror or satisfy mandatory statutory provisions in favour of Consumers shall not apply;
b) in the event of a dispute between the Seller and an Entrepreneur, sections 13.2 - 13.4 of the GTC relating to disputes between the Seller and a consumer shall not apply.

1.6 By submitting the order, the Buyer agrees that the confirmation of the details of the order placed and these GTC will be sent by email to the email address provided when registering on the Website or during the purchase transaction.

1.7 Buyers must be at least 21 years of age and have sufficient legal capacity to purchase one or more P ZERO^TM Experience Packages on the Website. The Buyer, who wants to purchase only the Gift Voucher on the Website can be 18 years of age or over but the Voucher’s Beneficiary must be aged 21 or over. In both cases, the Buyer of the P ZERO^TM Experience Package or the Gift Voucher must have legal capacity.

1.8. The Buyer shall bear all costs incurred in connection with the Website via the Internet, including all telephone costs incurred by the Buyer from its service provider.

2. Characteristics of the P ZERO™ Experience Package and the Gift Voucher; important rules for accessing the Circuit

2.1. Each PZERO™ Experience Package and the Gift Voucher are sold by the Seller with the characteristics described on the Website and in accordance with the terms and conditions published on the Website at the time the Buyer places the order, to the exclusion of any other terms and conditions.

2.2. The Seller reserves the right to amend these GTC, in whole or in part, at any time and at its sole discretion, without notice to the users of the Website. All changes take effect on the day they are published on the Website and only apply to orders placed from this date.

2.3. The selling price and/or characteristics of the PZERO^TM Experience Package and the Gift Voucher offered on the Website are subject to change without notice and therefore the Seller accepts no liability in the event of changes to the contents of the P ZERO™ Experience Package, Gift Voucher and/or the programme. Such changes only apply to orders placed thereafter. The Buyer is always recommended to check the final purchase price before placing the order in accordance with section 3 (see below).

2.4. The Website is accessible to users from all over the world; however, the P ZERO™ Experience Package offered on the Website can only be purchased by users who request the provision of the services provided for in the P ZERO™ Experience Package in Austria.

2.5. DDuring the purchase procedure of the P ZERO^TM Experience Package, the Buyer will have the choice to select one (1) additional driver (the “Additional Driver”), or the option to purchase a Gift Voucher selecting the P ZERO™ Experience Package for a third party, natural person (hereinafter the "Voucher’s Beneficiary“).

2.6. Access to the Circuit after the purchase of the P ZERO^TM Experience Package or a Gift Voucher is only granted to Buyers who
(i) are lawful owners or proprietors of the Cars;
(ii) are aged 21 or over;
(iii) have a valid driving license that has been issued for at least 36 (thirty six) months;
(iv) are not subject to a suspension or other sanctioning measures with respect to their driving license or driving a car.

No access to the Circuit itself will be granted to persons other than Buyers, the Additional Driver or the Voucher’s Beneficiary or vehicles other than the Car(s). Companions will be entitled to attend the Event, according to the P ZERO^TM Experience regulations.

2.7. The Buyer/driver, Additional Driver and/or the Voucher’s Beneficiary(as applicable) is granted access to the Circuit under the condition that they have read and unconditionally accepted:
i. the P ZERO™ Experience Regulations, which can be viewed here;
ii. the Indemnity Documents that the Circuit and the Seller will ask them to sign, which can be viewed here.

3. Purchase of the P ZERO™ Experience Package and/or the Gift Voucher – conclusion of each individual purchase contract

3.1 Any order submitted to the Seller by the Buyer via the Website constitutes a contractual offer and is subject to these GTC, which form an integral part of the order and which the Buyer fully accepts without reservation by placing the order. Before proceeding with the purchase of the P ZERO^TM Experience Package or a Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept the GTC and the documents referred to in section 2.7 online and either print a copy thereof by clicking on the "Print" function on his computer or save and retain a copy thereof for his own records. Companions who are not drivers can also fill in the documents on-site and sign them there. In this case, however, the Buyer must check the above rules in advance, so that the Buyer can ensure that the persons they may take on- site also meet the necessary requirements.

3.2. Acceptance of the Buyer's order (and the accompanying relevant payment as further detailed in Clause 7) shall be effected by the Seller sending an order confirmation (“Order Confirmation”) to the email address provided to the Seller by the Buyer prior to the confirmation of the purchase. The Order Confirmation shall include a link to the text of these GTC, the documents referred to in section 2.7, a summary of the order placed, including detailed price information, and

i. in case of a P ZERO™ Experience purchase, a description of the P ZERO™ Experience Package ordered together with a univocal alphanumeric code and details of the Buyer and the Additional Driver (if any), the day of the Event, the number and name of Companions (as defined in Clause 4.1), if any, and the model and license plate of the Car authorized to access the track (the e-mail is referred to as the “Access Pass”);
ii. in case of a Gift Voucher purchase, the day of the Event, the name of the Buyer, the name and e-mail address of the Voucher’s Beneficiary (if applicable), the number of Companions (if any). In this case, the email confirmation will also contain a univocal coupon code (the “Coupon Code”) and all the steps to be followed in order to receive the Access Pass. The Voucher’s Beneficiary will be requested to enter into an agreement with the Seller in which he/she will be subject to the provisions of Clause 2.6 and 2.7.

3.3. The Buyer's order, the Seller's Order Confirmation and the Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.

4. Selection and purchase of the P ZERO™ Experience Package and the Gift Voucher

4.1 The P ZERO™ Experience Package and Gift Voucher offered on the Website can be purchased by the Buyer by selecting the P ZERO™ Experience Package and/or the Gift Voucher of interest and placing it in the virtual shopping cart. One (1) P ZERO™ Experience Package and/or one (1) Gift Voucher may be purchased per order. Every P ZERO™ Experience Package purchased must include the Buyer and optionally (at an additional cost as detailed on the Website) one (1) Additional Driver and up to three (3) companions (the latter hereinafter referred to as "Companions")) in accordance with the P ZERO™ Experience Regulations. In case the Buyer wishes to purchase a Gift Voucher, the Gift Voucher can optionally include (at an additional cost as detailed on the Site) up to three (3) Companions, in compliance with the P ZERO™ Experience regulations. Before the Buyer can place an order, he must pre-register on the Pirelli websites intended for this purpose and provide the personal data required therein. The user then clicks on "anmelden" (register) and receives an email in which he clicks on "jetzt Anmeldung bestätigen” (confirm registration now). Clicking on the button in the email takes the Buyer to the landing page https://pzeroexperience.pirelli.com/en-de/circuits/redbullring where he can select and purchase his P ZERO™ Experience Package.

4.2. The name of the Buyer, the Additional Driver (if any) and the Voucher’s Beneficiary cannot be changed after the purchase procedure and no other person will be permitted to drive the Car registered by the Buyer or by the Voucher’s Beneficiary, as applicable.

4.3. After having selected the P ZERO™ Experience Package or the Gift Voucher, to complete the purchase of the P ZERO™ Experience Package or the Gift Voucher (as applicable) in its basket, the Buyer will be invited to provide his/her personal data as well as the personal data of the Additional Driver and of the Companions (if any), or the personal data and e-mail of the Voucher’s Beneficiary and of the Companions (if any) in order to complete the order and enable the contract to be finalised. The Buyer will see a summary of the order to be processed, containing the information detailed in Clause 3.2., having read them carefully, the Buyer must then expressly approve these Conditions and the documents indicated in paragraphs Clauses 2.7, by checking the appropriate box (check-box) on the Site and finally the Buyer will be asked to confirm his order with the "PURCHASE" button and submit payment in accordance with Clause 7 below. The order will then be sent to the Seller and will produce the effects described in the above Clause 3.2.

5. Delivery and use of the P ZERO™ Experience Package

5.1. In order to use the P ZERO™ Experience Package or the Gift Voucer, as applicable, the Buyer or the Voucher’s Beneficiary must present the Access Pass at the entrance to the Circuit on the day of the Event and comply with sections 2.6 and 2.7 of these GTC.

5.2. Should the Buyer or the Voucher’s Beneficiary be absent on the day of the Event, the right to use the P ZERO™ Experience Package expires without the option of a refund.

Price

6.1. The price of the P ZERO™ Experience Package and the Gift Voucher correspond to the prices displayed on the Website at the time the Buyer places the order. Prices include value added tax, as applicable (currently 20%).

6.2. The prices of the P ZERO™ Experience Package and of the Gift Voucher do not include costs for accommodation and meals, travel to and from the Circuit, or other costs not expressly specified.

6.3. The Buyer shall pay the Seller the full price as stated in the order and confirmed in the Order Confirmation sent by the Seller to the Buyer by email. In the event of a discrepancy between the price stated in the order and the price stated in the order confirmation, the price stated in the order shall apply.

7. Payment

7.1 Payment of the price of the P ZERO™ Experience Package and/or the Gift Voucher purchased through the Website must be made at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly agrees that performance of the Contract by the Seller shall only commence after crediting the purchase price for the purchased P ZERO™ Experience Package and/or the Gift Voucher to the Seller's current account.

7.2. Payment must be made by credit card or PayPal and the Buyer will therefore be required to provide the relevant information through a protected connection. For accounting and administration purposes, the Seller reserves the right to check the personal information provided by the Buyer. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.

7.3. During the payment process, the Buyer is forwarded to a protected website to the operator providing acquiring services to the Seller. The transmitted data is sent in protected mode by encrypting the information with a 128-bit or higher SSL (SecureSocketLayer) system. Not even the Seller can access this information.

7.4. The Seller shall immediately send the Buyer the tax receipt in electronic format for the purchase made or, on request, an electronic invoice to the email address provided by the Buyer.

8. Cancellation - refund conditions

8.1.PIRELLI reserves the right to cancel the Event for organisational, safety or weather related reasons, due to orders from authorities, or if the Circuit is no longer available and/or for reasons of force majeure (including an epidemic or pandemic). In this case, the Buyer is not entitled to a refund of the amount paid. This clause does not affect the provisions of section 8.3 and 8.4, which provides for a right of refund on cancellation as specified.

8.2 Should the Buyer or the Additional Driver or the Voucher’s Beneficiary be prevented from attending the Event due to orders from local or national authorities (e.g. bans or border closures), the Buyer is entitled to choose between a full refund or a voucher to take part in a P ZERO™ Experience that will be held in Europe during 2022. Any other refund is expressly excluded.

8.3. IIn the event that the Buyer or the Voucher’s Beneficiary (as applicable) wishes to cancel his taking part in the Event, the Buyer is entitled to a refund as follows:
Cancellation 30 days or more before the date of the Event: 100% refund
Cancellation between 14 and 29 days before the date of the Event: 50% refund
Cancellation 13 days or less before the date of the Event: no refund

8.4. Cancellation must be made by the Buyer (before a Voucher’s Beneficiary receives the Access Pass) or by the Voucher’s Beneficiary (after the Voucher’s Beneficiary receives the Access Pass) by sending an email to Customer Services.
If the Buyer is entitled to a refund, the Seller shall refund the corresponding amount without undue delay and in any case no later than 14 days after notification of the cancellation, with the exception of cases of delays that are not attributable to Seller. The Seller shall make such a refund using the same means of payment as the Buyer used to purchase the P ZERO^TM Experience Package or the Gift Voucher.

9. Exclusion of the right of withdrawal – exclusion of liability

9.1. According to § 312g (2) lit. 9 BGB, the Buyer has no right of withdrawal/revocation.

9.2. The Seller has no liability for (i) non-receipt by the Buyer or by the Voucher’s Beneficiary of the documentation on the P ZERO™ Experience Package or the Gift Voucher acquired, or due to (ii) non - or partial - utilisation of the P ZERO™ Experience Package or of the Gift Voucher due to incorrect information provided by the Buyer (for example, incorrect e-mail address, incorrect specification of the model and/or licence plate of the vehicle or information regarding the Buyer and/or the Voucher’s Beneficiary) or (iii) due to cancellation of the event to which the P ZERO™ Experience Package acquired pertains for reasons not imputable to the Seller.

10. Intellectual property rights

10.1. The Buyer acknowledges that he is aware that Pirelli & C. S.p.A., Pirelli Tyre S.p.A or, as the case may be, their respective owners (collectively and individually, the "Owners") have exclusive rights of use over all trademarks, names and other marks, including, but not limited to, the "PIRELLI" word and figurative mark and logo trademark, the "P ZERO™" trademark, as well as any images, photos, written texts or graphics used on the Website or relating to the P ZERO™ Experience Package, without the Buyer having any rights in this regard from accessing the Website and/or purchasing the P ZERO™ Experience Package or Gift Voucher.

10.2. The Website's content may not be reproduced, transmitted, modified or used for any purpose, in whole or in part, by electronic or conventional means, without the prior express written consent of the Owners.

11. Buyer's personal data and privacy 11.1. In order to process the order and conclude the contract on the basis of these GTC, some of the Buyer's (and/or of the Additional Driver’s, of the Companions and/or of the Voucher’s Beneficiary’s, as applicable) personal data is requested via the Website, as specified in sections 4.3 and 7. The Buyer acknowledges that the personal data he has provided for the purpose of the purchase will be collected and used for the purposes stated in the Privacy Policy.

11.2. The Buyer represents and warrants that the data provided during the registration and purchase process is true and accurate.

11.3. Further information on how the Buyer's personal data is processed can be found in the Privacy Policy.

12. Safety

12.1 Although the Seller has taken measures to protect personal data from loss, falsification, handling and misuse by third parties, the Seller cannot guarantee that the information or data entered by the Buyer on the Website, even after the Buyer has authenticated access (login), will not be accessible or visible to unauthorised third parties due to the technical features and restrictions on the protection of electronic communication via the internet.

12.2. With regard to credit card and Paypal payments, the Seller uses technical systems to ensure the highest level of reliability, security, protection and confidentiality when transferring information over the internet.

13. Applicable law, arbitration and jurisdiction

13.1. Any purchase agreement concluded between the Seller and the Buyer on the basis of these GTC is subject to Austrian law, and, in particular for Consumers, in accordance with the Austrian consumer protection laws, in particular the provisions applicable to consumer contracts. Any rights which may be attributed to Consumers through mandatory statutory provisions are reserved.

13.2. The mandatory Austrian rules for electronic commerce apply.

13.3. The Consumer can access the European Online Dispute Resolution Platform (European ODR Platform) to resolve disputes between himself and the Seller. The European ODR Platform has been developed and is managed by the European Commission in accordance with Directive 2013/11/EU and Regulation EU 524/2013 to facilitate an independent, impartial, transparent, efficient, fast and equitable resolution of out-of-court disputes relating to contractual obligations arising from online purchase or service contracts between a Consumer established in the EU and a Entrepreneur established in the EU through the involvement of an ADR body ("Alternative Dispute Resolution") to be selected from an available list of the same. 13.4. In the event that the Consumer or Seller does not take part in any of the arbitration attempts referred to in the preceding sections 13.3 or such an attempt results in a negative outcome, the dispute shall fall within the jurisdiction of the court in whose jurisdiction the Consumer resides or at the discretion of the Consumer in whose jurisdiction the Seller has his registered office.

13.5. Disputes between the Seller and a Entrepreneur fall under the exclusive jurisdiction of the courts in Vienna.

13.6. This English translation is made only in order to facilitate the understanding of this Terms and Conditions. In the event of any discrepancy between the German version and this English translation, the German version shall always prevail.

1. Subject

1.1. These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "P ZERO™ Experience Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”). The Buyer from a Third Party and the Voucher’s Beneficiary will be jointly referred to as the “User(s)”. The User will receive an univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).

1.2. Each P ZERO™ Experience Package or Gift Voucher will entitle the User, who will be registered by using the Coupon Code through the dedicated web page of the site https://pzeroexperience.pirelli.com/en-gb/ (hereinafter respectively the “Web Page” and the “Site”) to participate, at the Nürburgring (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the Car at the Circuit.

1.3. The Event is organized by Pirelli GmbH, with its registered office at Lemböckgasse 47a, 1230 Wien, Austria, value added tax ATU14205803 (hereinafter “PIRELLI”).

1.4 Any communication by the User, in connection with and/or in relation to the P ZERO™ Experience Package and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeroexperience.centraleurope@pirelli.com (hereinafter the "Customer Service").

1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the Site via the internet, including any telephony costs incurred by the User with his/her service provider.

2. The P ZERO™ Experience Package and Gift Voucher features and important rules for the access to the Circuit.

2.1. The P ZERO™ Experiences Package and the Gift Voucher are provided by PIRELLI with the features described on the Site and in accordance with these Conditions.

2.2. PIRELLI reserves the right to amend the agenda of the Event at any moment in time and as its own discretion.

2.3. The possibility of accessing the Circuit will be allowed only to Users who:
(i) have completed the registration procedure on the Web Page using the Coupon Code, indicating any companions (the “Companions”) and/or the additional driver (“Additional Driver”), where applicable;
(ii) are legitimate owners/keepers of the Car(s);
(iii) are 21 of age or over and have a driving license in the course of validity, issued for at least 36 (thirty six) months and not subject to suspension or other sanctioning measures;
(iv) have unconditionally accepted and agreed to the Circuit regulations
(v) have accepted and agreed to the P ZERO™ Experience regulations (inclusive of the Covid-19 Safety and Hygiene Measures) which will be provided by PIRELLI and which can be read and downloaded here;
(vi) have unconditionally accepted and agreed to the indemnity documents that the Circuit and PIRELLI will ask them to sign. Click here to read and download the indemnity documents of the Circuit and of PIRELLI.
2.4. The access to the Circuit will not be allowed to people other than the Users, their registered Companions and the Additional Driver (if any and where applicable), nor to cars other than the Cars and always in compliance with the P ZERO™ Experience Regulations. No other person out of the User and the Additional Driver (if any) will be permitted to drive the Car

3. P ZERO™ Experience Package and Gift Voucher registration procedure

3.1 Before proceeding with the registration using the Coupon Code, the User must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the list of Cars and the documents referenced under section 2.3 from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.

3.2. On the Web Page, the User will be invited to provide his/her personal data and the details of the Car he/she will drive during the Event, as well as personal data of the Companions and of the Additional Driver, if any and as applicable, in order to complete the registration process for the attendance to the Event.

3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address each User provided to PIRELLI, during the registration process, of an email confirming that the registration has been successfully completed, which will contain a link to the text of these Conditions, the name of the natural person who owns the P ZERO™ Experience Package or the Gift Voucher (both coinciding with the User), the names of the Companions (if any) and the name of the Additional Driver, if any and if applicable, the day of the Event, the model and licence plate of the Car authorised to access the track and a description of the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and the User may request copies by sending an email to Customer Service.

3.4 The User and the Additional Drive’s names (if any) cannot be changed after the receipt of the Access Pass.

4. Delivery and use of the P ZERO^TM Experience Package and/or of the Gift Voucher

4.1 To be able to use the P ZERO™ Experience Package or the Gift Voucher, as applicable, the User must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of clause 2.4 above.

4.2. The name of the Buyer, the Additional Driver (if any) and the Voucher’s Beneficiary cannot be changed after the purchase procedure and no other person will be permitted to drive the Car registered by the Buyer or by the Voucher’s Beneficiary, as applicable.

4.3. If the User is absent on the day of the Event, the right to use the P ZERO^TM Experience Package or the Gift Voucher will be lost, without possibility of reimbursement.

5. Cancellation Communications

5.1. In the event that the User wishes to cancel his/her participation in the Event, the User has to send an e-mail to the Customer Service. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by the entity who has sold the P ZERO™ Experience Package to the Buyer from a Third Party.

6. Intellectual Property Rights

6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site/Web Page or relating to P ZERO™ Experience Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the User in relation to the same as a result of access to the Site/Web Page and/or purchase of the P ZERO™ Experience Packages or Gift Vouchers.

6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.

7. Personal data and protection of privacy

7.1 To be able to proceed with the registration process of the User, Companions and Additional Driver, if any and as applicable, for the purpose of participating in the Event and based on these Conditions, some personal information of the User, of the Companions and of the Additional Driver if any and as applicable, will be requested through the Web Page, as indicated in Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the registration process for the Event will be collected and used for the purposes indicated in the PIRELLI Privacy Policy.

7.2. The User hereby declares and guarantees that the data provided during the registration process are correct and true.

7.3. For any other information relating to the processing of the personal data of the User, the Companions (if any) and the Additional Driver (if any), please refer to the PIRELLI Privacy Policy.

8. Security

8.1. Although PIRELLI has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the information or data displayed by the User on the Site and/or the Web Page, will not be accessible or viewable by unauthorized third parties.

9. Applicable law and jurisdiction

9.1. These Conditions shall be governed by and construed in accordance with Austrian Law.

9.2. In case of any disputes arising between PIRELLI and the User the same shall be deferred to the exclusive jurisdiction of the Courts of Wien, Austria.

9.3. This English translation is made only in order to facilitate the understanding of these Conditions. In the event of any discrepancy between the German version and this English translation, the German version shall always prevail.
