1. Subject
1.1. These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural
person who (i) purchased a package named P ZERO™ Experience (hereinafter the "PZE
Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or
(ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”). The
Buyer from a Third Party and the Voucher’s Beneficiary will be jointly referred to as the “User(s)”.
The User will have received a univocal code (hereinafter the "Coupon Code") for his/her
registration, necessary to participate in the Event (as defined in Section 1.2 below).
1.2. Each PZE Package or Gift Voucher will entitle the User and a companion (where a
‘companion package’ is purchased by the User(s) as part of the PZE Package) (the “Companion”)
who will be registered by using the Coupon Code through the dedicated web page of the site
https://pzeroexperience.pirelli.com/en-ww/homepage (hereinafter respectively the “Web Page”
and the “Site”) to:
1.2.1 Participate, at the Goodwood Motor Circuit (hereinafter the "Circuit") in a day on
track with the User’s’ own car (the “Event”), subject to such car being on the list
of approved vehicles published on the Site (“Car(s)”) on Thursday 26th September
2024;
1.2.2 One nights’ standard room accommodation (for the User only) at The Goodwood
Hotel on Wednesday 25th September 2024 (with breakfast included);
1.1.2.1 Any upgrade from the standard room may be available to purchase
directly from The Goodwood Hotel, subject to availability; and
1.1.2.2 Additional hotel room accommodation is not included for the
Companion but may be available to purchase directly from The
Goodwood Hotel, subject to availability.
1.2.3 An evening meal on Wednesday 25th September 2024.
Subject to availability, additional hotel room accommodation for the Companion or an upgrade to
the standard room provided shall attract additional costs at rate(s) charged by The Goodwood
Hotel.
1.3. The PZE Packages and Gift Vouchers are sold by Pirelli UK Tyres Limited, with its registered
office at Derby Road, Burton on Trent, DE13 0BH (hereinafter “PIRELLI”).
1.4. Any communication by the User, in connection with and/or in relation to the PZE Package
and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon
Code shall be made to the addresses and in accordance with the modalities indicated on the Site or
to the email address pzeuk@pirelli.com (hereinafter the "Customer Service").
1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the
Site via the internet, including any telephony costs incurred by the User with his/her service
provider.
2. The PZE Package features and important rules for the access to the Circuit.
2.1. The PZE Package and the Gift Voucher are provided by PIRELLI with the features described
on the Site and in accordance with these Conditions.
2.2. PIRELLI reserves the right to amend the agenda of the Event at any moment in time and as
its own discretion.
2.3. The PZE Packages and/or the characteristics of the same, are subject to change without notice
and therefore, the Seller does not assume any responsibility in the event of changes in the contents
of the PZE Package and/or program variations.
2.4. Access to the Circuit, following the procurement of a PZE Package, will only be allowed to
Users: (i) whose vehicle features on the list of Cars published on the Site; and who (ii) hold a valid
driving licence entitling them to drive such vehicles.
2.5. Access to the Circuit by each User is subject to:
(i) the unconditional acceptance and agreement by the User of the indemnity documents that the
Seller and the car manufacturers (where appropriate) will ask the User to sign;
(ii) the acceptance and agreement to the PZE regulations (which incorporate any Circuit
regulations.
2.6. Access to the Circuit will not be allowed to people other than the Users, their registered
Companions (if any), nor to cars other than the Cars and always in compliance with the PZE
Regulations.
3. PZE Package and Gift Voucher registration procedure
3.1. Before proceeding with the registration using the Coupon Code, the User must carefully read
and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the
list of Cars for compatibility with their vehicle and the documents referenced under section 2.3
from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.
3.2 On the Web Page, the User will be invited to provide his/her personal data and the details of
the Car he/she will drive during the Event, as well as personal data of the Companion(s) if any, in
order to complete the registration process for the attendance to the Event.
3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address
each User provided to PIRELLI, during the registration process, of an email confirming that the
registration has been successfully completed, which will contain a link to the text of these
Conditions, the name of the natural person who is registered to use PZE Package or the Gift
Voucher (both coinciding with the User), the names of the Companion(s) (if any), the day of the
Event, the model and licence plate of the Car authorised to access the track and a description of
the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship
between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and
the User may request copies by sending an email to Customer Service.
3.4 The User cannot be changed after receipt of the Access Pass.
4. Delivery and use of the PZE Package and/or of the Gift Voucher
4.1. To be able to use the PZE Package or the Gift Voucher, as applicable, the User must show the
Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of
clause 2.4 above.
4.3. If the User is absent on the day of the Event, the right to use the PZE Package or the Gift
Voucher will be lost, without possibility of reimbursement.
5. Cancellation Communications
5.1. In the event that the User wishes to cancel his/her participation in the Event, the User must
send an e-mail to Customer Service. Any refund, if applicable (depending on the timing of the
cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by
the entity who sold the PZE Package to the Buyer from a Third Party.
6. Intellectual Property Rights
6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive
signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™”
trademark as well as any images, photographs, written text or graphics used on the Site/Web Page
or relating to PZE Packages and Gift Vouchers are and remain the exclusive property of Pirelli &
C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the
“Owners”), with no rights arising on the part of the User in relation to the same as a result of
access to the Site/Web Page and/or purchase of the PZE Packages or Gift Vouchers.
6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web
Page can be wholly or partially reproduced, transferred using electronic or conventional means,
modified or used for whatever purpose.
7. Personal data and protection of privacy
7.1. To be able to proceed with the registration process of the User and any Companion(s), for the
purpose of participating in the Event and based on these Conditions, some personal information
of the User, of the Companions (if any), will be requested through the Web Page, as indicated in
Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the
registration process for the Event will be collected and used for the purposes indicated in the
PIRELLI Privacy Policy which can be accessed using the following link: https://www.pirelli.com/
tyres/en-gb/learn/privacy-policy.
7.2. The User hereby declares and guarantees that the data provided during the registration process
are correct and true.
7.3. For any other information relating to the processing of the personal data of the User, the
Companions (if any), please refer to the PIRELLI Privacy Policy.
8. Security
8.1. Although PIRELLI has adopted measures to protect personal data against any loss,
falsification, handling, and misuse by third parties, given the technical features and limitations on
the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the
information or data displayed by the User on the Site and/or the Web Page, will not be accessible
or viewable by unauthorized third parties.
9. Applicable law and jurisdiction
9.1 These Conditions shall be governed by and construed in accordance with laws of England and
Wales.
9.2 In case of any disputes arising between PIRELLI and the User the same shall be deferred to
the exclusive jurisdiction of the Courts of England and Wales.
1. Subject
1.1. These general terms and conditions of sale (hereinafter the “Conditions”) shall apply to the purchase, by users falling within the definition of “Consumers” and of “Professionals” (as defined in clause 1.2 below), through the website https://pzeroexperience.pirelli.com/en-gb/circuits/ silverstone (hereinafter the “Site”) of the package named “P ZERO™ Experience” (hereinafter the "PZE Package" or the "PZE Packages") or a gift voucher for the PZE Package (“Gift Voucher”) which will entitle the Buyer (as defined in clause 1.2 below) and the Voucher Beneficiary (defined in clause 2.5 below) to participate, at the Silverstone Circuit (hereinafter the "Circuit") in a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”).
The dates available for the Event and the descriptions of the PZE Package are published on the Site.
1.2. The PZE Packages and Gift Vouchers are sold by Pirelli UK Tyres Limited, with its registered office at Derby Road, Burton on Trent, DE13 0BH (hereinafter, the "Seller").
The parties involved in the purchase of PZE Packages or Gift Vouchers (as applicable) via the Site shall be the Seller and the party who purchases the PZE Packages or Gift Vouchers (as applicable) either: (i) for reasons other than in relation to the profession, business, trade or craft conducted by that party or that of another party (hereinafter the "Consumer"); or (ii) in relation to the profession, business, trade or craft conducted by that party, (hereinafter the "Professional"); as the buyers (the Consumer and the Professional shall individually be referred to as the “Buyer” and jointly as the “Buyers”). The Seller and the Buyer, as the case may be, shall be referred to jointly as the "Parties".
During the purchasing procedure of the PZE Package or the Gift Voucher (as applicable) the Buyer will be required to enter the details of the person(s) who are to drive the Car at the Circuit. (“Driver”) 1.3. Any communication by the Buyer, in connection with and/or in relation to the purchase of a PZE Package or Gift Voucher (as applicable), including, but not limited to any notifications, claims or requests concerning the purchase and/or delivery of the PZE Package or Gift Voucher (as applicable), shall be made to the Seller at the addresses and in accordance with the methods indicated on the Site or to the email address pzeuk@pirelli.com (hereinafter the "Customer Service").
1.4. All purchases are regulated by the Conditions, as published on the Site at the time the order is submitted by the Buyer.
1.5. If one or more sales are made to a Professional, the Conditions shall apply but, notwithstanding the provisions of the same:
a) the Professional will not be recognised by any other protections provided herein in favour of Consumers, which reflect or comply with mandatory provisions of law;
b) for disputes between the Seller and a Professional, clause 12.4 of the Conditions, referring to disputes between the Seller and a Consumer shall not apply.
1.6. Buyers must be aged 18 or over in order to make purchases of PZE Packages or Gift Vouchers on the Site and to access the Circuit and participate in such events.
1.7. The Buyer shall be responsible for any costs incurred to connect to the Site via the internet, including any telephony costs incurred by the Buyer with their service provider.
2. Features and important rules for the access to the Circuit
2.1. The PZEs Packages and Gift Vouchers are sold by the Seller with the features and in accordance with the Conditions published on the Site at the time the order is sent by the Buyer, with the exclusion of any other terms or conditions.
2.2. The Seller reserves the right to amend all or part of the Conditions, at any moment in time, and at its own discretion without giving any notice to users of the Site. Any amendments made shall come into force from the date on which they are published on the Site and will only apply to orders placed from that date onwards.
2.3. Sale prices, the PZE Packages and Gift Vouchers sold on the Site and/or the characteristics of the same, are subject to change without notice and therefore, the Seller does not assume any responsibility in the event of changes in the contents of the PZE Package, Gift Voucher and/or program variations. Such changes shall only apply to orders placed after the date of such changes being implemented. In any case, the Buyer is advised to check the final purchase price before submitting their order, pursuant to clause 3 below.
2.4. Users from all over the world may access the Site; however, the PZE Package and Gift Vouchers available on the Site should only be purchased by users who wish to participate in such event in the UK at the Circuit. During the purchasing procedure, the Buyer will have the option to purchase a Gift Voucher for a third party, natural person (“Voucher Beneficiary”).
2.5. Access to the Circuit, following the purchase of a PZE Package or Gift Voucher, will only be allowed to the Buyer or Voucher Beneficiary (as applicable): (i) whose vehicle features on the list of Cars published on the Site; and who (ii) hold a valid driving licence entitling them to drive such vehicles. A Companion will be entitled to attend the Event in accordance with the PZE Regulations (defined in clause 2.6(ii) below).
2.6. Access to the Circuit by each Buyer or Voucher Beneficiary is subject to:
(i) the unconditional acceptance and agreement by the Buyer or Voucher Beneficiary (as applicable) of the indemnity documents that the Seller and the car manufacturers will ask the Buyer or Voucher Beneficiary (as applicable) to sign, which can be seen here
(ii) the acceptance and agreement to the PZE regulations (which incorporate any Circuit regulations), which can be seen here(“PZE Regulations”).
3. Conclusion of each individual purchase contract
3.1. Each order submitted by the Buyer to the Seller via the Site has the value of a contractual proposal and is subject to the Conditions which form an integral part of the order and which the Buyer, by placing the order, fully accepts without any reservation. Before proceeding with the purchase of the PZE Package or Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept (and print and/or save copies, for their records of) the Conditions together with the documents detailed in clause 2.6.
3.2. A contract is formed when the Buyer's order (accompanied by the relevant payment as further detailed in clause 7) is accepted by the Seller by sending to the Buyer (at the e-mail address provided by the Buyer during the purchase procedure) an e-mail confirming that the order has been accepted ("Order Confirmation"). This email confirmation will contain a link to the text of the Conditions, a summary of the order placed (including detailed price information and date), and a description of the PZE Package ordered together with a pdf attachment containing the unique alphanumeric code and details of the Driver, the name of the Buyer’s accompanying person (if any), and the model and licence plate of the Car participating at the Circuit (hereinafter, the “Pass”). Voucher Beneficiaries will be subject to the provisions of clause 2.5 and 2.6 of the Conditions and may be required to enter into an agreement with the Seller in respect thereof.
3.3. The Buyer's order, the Order Confirmation and the Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.
4. Selection and purchasing procedure
4.1. The PZE Packages and Gift Vouchers presented on the Site can be purchased by the Buyer's selecting the PZE Package or Gift Voucher of interest and placing it in the virtual purchase basket. One (1) PZE Package and/or one (1) Gift Voucher may be purchased with each order. Each PZE Package purchased must include the Buyer and optionally, one additional accompanying person (at an additional cost as detailed on the Site). For each Gift Voucher purchase, the Buyer can optionally include up to one (1) Companion, in compliance with the PZE Regulations. The name of the Buyer or Voucher Beneficiary (as applicable) cannot be changed after the purchase and no other persons will be permitted to drive the Car at the Circuit.
4.2. After having selected the PZE Package or Gift Voucher the Buyer will be invited to provide his/her personal data or that of the Voucher Beneficiary (as applicable) and any Companion in order to complete the order and purchase of the PZE Package or Gift Voucher in their basket and enable the contract to be finalised. The Buyer will see a summary of the order to be processed, containing the information detailed in clause 3.2 above. Having read them carefully, the Buyer must then expressly approve the Conditions and the documents referenced under clause 2.6, by checking the appropriate boxes (check-box) on the Site and finally, the Buyer will be asked to confirm his/her order with the "PURCHASE" button and submit payment in accordance with clause 7 below. The order will then be sent to the Seller and an Order Confirmation issued, as detailed in clause 3.2 above.
5. Delivery and use of the PZE Package and/or Gift Voucher
5.1 To be able to use the PZE Package or Gift Voucher, the Buyer or Voucher Beneficiary (as applicable) must show the Pass (as defined in clause 3.2 above) at the entry to the Circuit on the day of the Event, and comply with the provisions of clauses 2.5 and 2.6 above.
5.2 If the Buyer or Voucher Beneficiary (as applicable) is absent on the day of the Event, the right to use the PZE Package or Gift Voucher (as applicable) will be lost, without the possibility of reimbursement.
6. Prices
6.1. The price of a PZE Package and Gift Voucher is as indicated on the Site at the time the Buyer sends the order. Prices include VAT.
6.2 For the avoidance of doubt, the prices on the Site do not include the costs of any accommodation, travel to and/or from the Circuit, or any costs not expressly specified.
7. Payment
7.1. Payment of the price of the PZE Package and/or Gift Voucher purchased through the Site will be taken by the Seller at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly accepts that execution of the contract by the Seller will only start after the price of the PZE Package or Gift Voucher purchased is credited to the current account of the Seller.
7.2. Payment must be made by credit or debit card or by Paypal, and the Buyer will therefore be required to provide the relevant information through a protected connection. For accounting and administration purposes, the Seller reserves the right to check the personal information provided by the Buyer. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.
7.3. During the payment procedure, the Buyer will be transferred on a protected site to the operator that provides acquiring services for the Seller. The data transmitted will be sent in protected mode, by encrypting the information with a 128 bit or higher SSL (SecureSocketLayer) system. The Seller cannot access this information.
7.4. The Seller will promptly transmit to the Buyer, in electronic format to the e-mail address provided by the Buyer, the VAT receipt for the purchase made.
8. Cancellation - Refund
8.1. The Seller will not be liable to the Buyer for failure to perform any of its obligations to the extent that the failure is caused by a force majeure event (meaning any cause beyond the Seller’s reasonable control including without limitation, acts of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments or any epidemic or pandemic). In the event of imposition of governmental restrictions (for example reference mobility or the ability to hold such events), the Seller shall offer an alternative date (if possible) or provide a full refund to the Buyer, at the Buyer’s discretion. This clause does not affect the terms of clause 8.2 below, specifically providing for a right of refund in any other circumstances.
8.2. In the event that the Buyer wishes to cancel his/her participation in the PZE Package or a purchased Gift Voucher, the Buyer’s entitlement to any refund will be as follows:
• cancellation 30 days or more prior to the date of the PZE Package: 100% refund
• cancellation between 14 to 29 days prior to the date of the PZE Package: 50% refund
• cancellation of 13 days or less prior to the date of the PZE Package: no refund
8.3 Any cancellations must be communicated to the Seller by sending an e-mail to Customer Service. In case the Buyer is entitled to a refund, the Seller shall refund the relevant amount without undue delay. The Seller will make such refund using the same means of payment (credit/debit card or Paypal) used by the Buyer for purchase of the PZE Package or Gift Voucher (as applicable). The Buyer will receive, within 7 days from his/her communication of cancellation, an email from Seller informing that the authorisation to the refund has been transmitted to the payment circuit used by the Buyer for the purchase. The effective time of refund will depend on such payment circuit and no responsibility will be attributable to the Seller for the effective time refund.
8.4. The Seller shall not be liable for occasions where the Buyer or Voucher Beneficiary is unable to access the Circuit due to: (i) non-receipt of the order documentation containing the requested information; or (ii) incorrect information provided by the Buyer (for example, incorrect e-mail address, incorrect specification of the model and/or licence plate of the Car to be used on the Circuit or incorrect information regarding the Buyer or Voucher Beneficiary).
9. Intellectual Property Rights
9.1. The Buyer acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site or relating to PZE Packages or Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., Pirelli Tyre S.p.A. or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the Buyer in relation to the same as a result of access to the Site and/or purchase of the PZE Packages or Gift Vouchers.
9.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.
10. Personal data of the Buyer and protection of privacy
10.1. To be able to proceed to process the order and conclude the contract based on the Conditions, some personal information of the Buyer and/or the Voucher Beneficiary (as applicable) will be requested through the Site, as indicated in clauses 7 and 8. The Buyer acknowledges that the personal data he/she provides for the purpose of the purchase will be collected and used for the purposes indicated in the Seller's Privacy Policy. The Buyer acknowledges that the Seller's Privacy Policy regarding the processing of personal data for the purposes of the PZE Packages or Gift Vouchers can be accessed through the Site.
10.2. The Buyer declares and guarantees that the data provided during the purchasing process are correct and true.
11. Security
11.1. Although the Seller has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, the Seller cannot guarantee that the information or data input by the Buyer on the Site, even after the Buyer has authenticated access (login), will not be accessible or viewable by unauthorized third parties.
11.2. With regard to card and Paypal payments, the Seller adopts technological systems to guarantee the highest levels of reliability, security, protection and confidentiality in the transmission of information via the web.
12. Applicable law, conciliation and jurisdiction
1. Each purchasing contract entered into between the Seller and the Buyer pursuant to the Conditions shall be governed by and construed in accordance with English Law and, in particular, for Consumers, in accordance with the Consumer Contract Regulation 2013, the Consumer Rights Act 2015 and, also for the Professionals, in accordance with the Supply of Goods and Services Act 1982. In any case, the rights attributed to the Consumers by mandatory provisions of laws, when applicable, are reserved.
2. In case of any queries or complaints regarding a purchase, please contact the Seller using the Customer Service contact details, quoting any order reference numbers.
3. If any dispute arises, the Seller shall use its reasonable endeavours to consult or negotiate in good faith and attempt to reach a just and equitable settlement satisfactory to the Buyer.
4. As an alternative to the conciliation attempt referred to in the preceding clauses, the Consumer, in order to resolve any dispute arising between the latter and the Seller, may also access the European Online Dispute Resolution platform (the European ODR Platform). The European ODR Platform has been developed and is managed by the European Commission, in accordance with Directive no. 2013/11/EU and Regulation EU no. 524/2013, in order to facilitate an independent, impartial, transparent, efficient, rapid and just resolution of out-of-court disputes relating to contractual obligations arising out of online sale or service contracts between a consumer residing in the European Union and a professional established within the EU, through the intervention of an ADR (“Alternative Dispute Resolution”) body, to be selected from a list available thereof. 5. In the event that the Consumer or the Seller does not adhere to one of the conciliation attempts referred to in clauses 12.3 or 12.4 above, or such attempt has a negative outcome, the dispute shall be deferred to the jurisdiction of the Courts of England or Wales.
6. In case of disputes arising between the Seller and a Professional, the same shall be deferred to the exclusive jurisdiction of the Courts of England and Wales.

These general terms and conditions of sale (hereinafter the “Conditions”) shall apply to the purchase, by users falling within the definition of “Consumers” and of “Professionals”, pursuant to the following Clause 1.2, through the website P ZERO™ Experience AT | Get on the track on the famous circuits (pirelli.com) (hereinafter the “Site”) of the package named “P ZEROTM Experience” or the gift voucher for the P ZEROTM Experience (hereinafter respectively the "P ZEROTM Experience Package" and the “Gift Voucher”) which will entitle the Buyer and the Voucher’s Beneficiary (as defined below) to participate, at the Red Bull-Ring Circuit (hereinafter the "Circuit") to a day on track with his/her own car (hereinafter the “Event”), subject to such car being on the list of approved vehicles published on the Site (hereinafter the “Car(s)”).The date available for the use of the P ZEROTM Experience Package and the Gift Voucher (as applicable) and their descriptions are published on the Site.
1.2. The P ZEROTM Experience Package and the Gift Voucher are sold by Pirelli GmbH, with registered office at Lemböckgasse 47 A, 1230 Wien, Austria, Vat No: ATU14205803 (hereinafter "PIRELLI").
The parties involved in the purchase of the P ZEROTM Experience Package and the Gift Voucher (as applicable) via the Site shall be PIRELLI, as seller (hereinafter the "Seller") and the party, who purchases the P ZEROTM Experience Package and the Gift Voucher not for the operation of his/her business pursuant to Section 1 of the Austrian Consumer Protection Act (Konsumentenschutzgesetz) (hereinafter the "Consumer"), or for the operation of his/her business (hereinafter the "Professional") as the buyers (the Consumer and the Professional shall individually be referred to as the “Buyer” and jointly as the “Buyers”). The Seller and the Buyer, as the case may be, shall be referred to jointly as the "Parties".
Pursuant to the Conditions, the people whose details are registered as the Buyer, the Additional Driver (if any) or the Voucher’s Beneficiary (if applicable) during the purchase procedure of the P ZEROTM Experience Package and/or the Gift Voucher, are the people who will be the only one(s) to be entitled to drive the Car at the Circuit.
1.3. Any communication by the Buyer, in connection with and/or in relation to the purchase of the P ZEROTM Experience Package and/or the Gift Voucher (as applicable), including, but not limited to any notifications, claims or requests concerning the purchase and/or delivery of the P ZEROTM Experience Package and/or the Gift Voucher (as applicable) shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeroexperience.centraleurope@pirelli.com (hereinafter the "Customer Service").
1.4. All purchases are regulated by the Conditions published on the Site at the time the order is submitted by the Buyer.
1.5. If one or more sales are made to a Professional, the Conditions shall apply but, notwithstanding the provisions of the same: the Professional will not be recognized any other protections provided herein, in favor of the Consumer, which reflect or comply with mandatory provisions of law; for disputes between the Seller and a Professional, Articles 13.2 – 13.4 of the Conditions, referring to disputes between the Seller and a Consumer shall not apply.
1.6. When the purchase order is transmitted, the Buyer accepts that confirmation of the information on the order made, and on these Conditions, sent to them via e-mail to the address they provided during registration on the Site, or during the purchase process.
1.7. Buyers must be aged 21 or over in order to make purchases of one or more P ZEROTM Experience Packages on the Site. Differently, the Buyer who wants to purchase only the Gift Voucher on the Site can be 18 years of age or over but the Voucher’s Beneficiary must be aged 21 or over. In both cases, the Buyer of the P ZEROTM Experience Package or the Gift Voucher must have legal capacity.
1.8. The Buyer shall be responsible for any costs incurred to connect to the Site via the internet, including any telephony costs incurred by the Buyer with their service provider, with the exception of telephony costs resulting from a Consumer contacting the Seller after the conclusion of the contract that are higher than the basic rates provided by their service provider.
2. The P ZEROTM Experience Packages and Gift Voucher features and important rules for the access to the Circuit
2.1. The P ZEROTM Experiences Package and the Gift Voucher are sold by the Seller with the features and in accordance with the Conditions published on the Site, at the time the order is sent by the Buyer, with the exclusion of any other terms or conditions.
2.2. Users from all over the world can access this Site; however, the P ZEROTM Experience Package and the Gift Voucher, available on the Site, should only be purchased by users who request the execution of the P ZEROTM Experience Package in Austria.
2.3. During the purchase procedure of the P ZERO™ Experience Package, the Buyer will have the choice to select one (1) additional driver (the “Additional Driver”), or the option to purchase a Gift Voucher selecting the P ZEROTM Experience Package for a third party, natural person (hereinafter the "Voucher’s Beneficiary”).
2.4. Access to the Circuit, following the purchase of a P ZEROTM Experience Package or a Gift Voucher (as applicable), will be allowed to Buyer, Additional Driver and Voucher’s Beneficiary (as applicable) who: are legitimate owners/keepers of the Car(s) and are aged 21 or over and have a driving license in the course of validity, issued for at least 36 (thirty-six) months and not subject to suspension or other sanctioning measures. Access to the Circuit will not be allowed to people other than the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) nor to car(s) other than the Car(s). Companions will be entitled to attend the Event, according to the P ZEROTM Experience regulations.
2.5. Access to the Circuit by each Buyer, Additional Driver or Voucher’s Beneficiary (as applicable) is subject to:
(i) the acceptance and agreement by the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) of the Circuit regulations;
(ii) the acceptance and agreement by the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) of the P ZEROTM Experience regulations which will be provided by the Seller and which can be read and downloaded here;
(iii) the acceptance and agreement by the Buyer, the Additional Driver or the Voucher’s Beneficiary (as applicable) of the indemnity documents that the Circuit and the Seller will ask them to sign. Click here to read and download the indemnity documents of the Circuit and the Seller.
3. P ZEROTM Experience Package and Gift Voucher purchase procedure – Conclusion of each individual purchase contract
3.1. Each order submitted by the Buyer to the Seller via the Site has the value of a contractual proposal and is subject to these Conditions which form an integral part of the purchase order and which the Buyer, by placing the order, fully accepts without any reservation. Before proceeding with the purchase of the P ZEROTM Experience Package or a Gift Voucher by placing an order with the Seller, the Buyer must carefully read and fully accept the Conditions (and print and/or save copies for his/her records) of the Conditions together with the documents detailed in Clause 2.5 above.
3.2. A contract is formed when the Buyer's order (accompanied by the relevant payment as further detailed in Clause 7) is accepted by the Seller by sending to them (at the e-mail address provided by the Buyer during the purchase procedure) an e-mail confirming that the order has been accepted (the “Order Confirmation”). This email confirmation will contain a link to the text of these Conditions and to the documents to be signed before accessing the Circuit, a summary of the order placed, including detailed price information and:
(i) in case of a P ZERO™ Experience purchase, a description of the P ZERO™ Experience Package ordered together with a univocal alphanumeric code and details of the Buyer and the Additional Driver (if any), the day of the Event, the number and name of Companions (as defined in Clause 4.1), if any, and the model and licence plate of the Car authorised to access the track (the e-mail is referred to as the “Access Pass”);
(ii) in case of a Gift Voucher purchase, the day of the Event, the name of the Buyer, the name and e-mail address of the Voucher’s Beneficiary (if applicable), the number of Companions (if any). In this case, the email confirmation will also contain a univocal coupon code (the “Coupon Code”) and all the steps to be followed in order to receive the Access Pass. The Voucher’s Beneficiary will be requested to enter into an agreement with the Seller in which he/she will be subject to the provisions of Clause 2.4 and 2.5.
3.3. The Buyer's order, the Order Confirmation and the Conditions applicable to the relationship between the Parties, will be archived electronically by the Seller in its IT systems, and the Buyer may request copies by sending an e-mail to Customer Service.
4. Selection procedure and purchasing of the P ZEROTM Experience Packages and the Gift Voucher
4.1. The P ZEROTM Experience Package and the Gift Voucher presented on the Site may be purchased by the Buyer's selecting of the P ZEROTM Experience Package and/or the Gift Voucher (as applicable) of interest and placing it in the virtual purchase basket. One (1) P ZEROTM Experience Package and one (1) Gift Voucher may be purchased with each order. Each P ZEROTM Experience Package purchased must include the Buyer, and, optionally (at an additional cost as detailed on the Site) one (1) Additional Driver and up to three (3) accompanying persons (hereinafter referred to as “Companion(s)”), in compliance with the P ZEROTM Experience regulations (5). In case the Buyer wishes to purchase a Gift Voucher, the Gift Voucher can optionally include (at an additional cost as detailed on the Site) up to three (3) Companions, in compliance with the P ZERO™ Experience regulations.
4.2. The names of the drivers of the Car registered by the Buyer or by the Voucher’s Beneficiary (including the Additional Driver if any) can be changed after completion of the purchase procedure, only once and for serious and documented reasons (such as, by way of example, illnesses and injuries) to be communicated at least 2 (two) days before the Event. In this case, the person indicated as substitute driver (the “Substitute Driver”) must, as a condition for participating in the Event, sign for acceptance the document that can be read and downloaded by clicking here. Furthermore, the Substitute Driver must show the Access Pass at the entrance to the Circuit on the day of the Event.
4.3. After having selected the P ZEROTM Experience Package or the Gift Voucher, to complete the purchase of the P ZEROTM Experience Package or the Gift Voucher (as applicable) in its basket, the Buyer will be invited to provide his/her personal data, as well as personal data of the Additional Driver and of the Companions, (if any), or the personal data and email of the Voucher’s Beneficiary and of the Companions (if any) in order to complete the order and enable the contract to be finalised.
The Buyer will see a summary of the order to be processed, containing the information detailed in Clause 3.2. Having read them carefully, the Buyer must then expressly approve these Conditions and the documents referenced under Clause 2.5, by checking the appropriate boxes (checkbox) on the Site and finally the Buyer will be asked to confirm his/her order by clicking the "PROCEED” button and submit payment in accordance with Clause 7 below. The order will then be definitively sent to the Seller and will produce the effects described in the above Clause 3.2.
5. Delivery and use of the P ZEROTM Experience Package and/or of the Gift Voucher – Responsibilities attributable to the Buyer
5.1. To be able to use the P ZEROTM Experience Package or the Gift Voucher, as applicable, the Buyer or the Voucher’s Beneficiary (as applicable) must show the Access Pass at the entry to the Circuit on the day of the Event and comply with the provisions of Clauses 2.4 and 2.5.
5.2. The Buyer will be responsible for non-use or partial use of the P ZERO™ Experience Package or the Gift Voucher due to incorrect indications or facts attributable to him/her (by way of example, incorrect indication of the email for receipt of the documentation relating to the Package P ZERO™ Experience or of the purchased Gift Voucher, incorrect indication of data relating to the Buyer, entry to the Event with a different model of Car from those permitted).If the Buyer or the Voucher’s Beneficiary (as applicable) are absent on the day of the Event, the right to use the P ZEROTM Experience Package will be lost, without prejudice to provisions of Clause 8.
6. Prices
6.1. The prices of the P ZEROTM Experience Packages and of the Gift Voucher are indicated on the Site at the time the Buyer sends the order. Prices include VAT (at 20%).
6.2. The prices of the P ZEROTM Experience Packages and the Gift Voucher do not include the costs of board and lodging, travel to and from the Circuit, or any costs not expressly specified.
6.3. The Buyer must pay the Seller the total price, as stated in the order and confirmed in the order confirmation sent by e-mail from the Seller to the Buyer. In the event of a discrepancy between the price stated in the order and the price stated in the order confirmation, the price stated in the order shall prevail.
7. Payments
7.1. Payment of the price of the P ZEROTM Experience Package and of the Gift Voucher purchased through the Site must be made at the same time the Seller sends the Order Confirmation to the Buyer. The Buyer expressly accepts that execution of the contract by the Seller will only start after the price of the P ZEROTM Experience Package or the Gift Voucher purchased, as applicable, is credited to the current account of the Seller.
7.2. Payment must be made by credit card or PayPal and the Buyer will therefore be required to provide the relevant information through a protected connection. The amount of the purchase will be debited when the Seller sends the Order Confirmation to the Buyer. The information provided by the Buyer at the time the order is transmitted will be used for invoicing.
7.3. During the payment procedure, the Buyer will be transferred on a protected site to the operator that provides acquiring services for the Seller. The data transmitted will be sent in protected mode, by encrypting the information with a 128-bit or higher SSL (SecureSocketLayer) system. Not even the Seller can access this information.
7.4. The Seller will promptly transmit to the Buyer, in electronic format to the e-mail address provided by the latter, the tax receipt for the purchase made, or an electronic invoice, if requested.
8. Refund
8.1. In the event that the Buyer or the Voucher’s Beneficiary (as applicable) wishes to cancel his/her participation in the Event, the Buyer’s entitlement to any refund will be as follows:
cancellation 30 days or more prior to the date of the Event: 100% refund
cancellation between 14 to 29 days prior to the date of the Event: 50% refund
cancellation of 13 days or less prior to the date of the Event: no refund.
8.2. Cancellation has to be made by the Buyer (before the Voucher’s Beneficiary receives the Access Pass) or by the Voucher’s Beneficiary (after the Voucher’s Beneficiary receives the Access Pass) by sending an e-mail to the Customer Service. In case the Buyer is entitled to a refund, the Seller shall refund the relevant amount without undue delay and in any event no later than 14 days from the communication of cancellation, exception made for delays not attributable to the Seller. The Seller will make such refunds using the same means of payment used by the Buyer to purchase the P ZERO™ Experience Package or the Gift Voucher.
9. Exclusion of the withdrawal right
9.1. The Buyer has no right of withdrawal pursuant to Section 18 (1) (10) of the Austrian Act on Distance Selling and Sales Off Premises (Fern- und Auswärtsgeschäfte-Gesetz).
10. Intellectual Property Rights
10.1. The Buyer acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site or relating to P ZERO™ Experience Package and Gift Voucher are and remain the exclusive property of Pirelli & C. S.p.A., Pirelli Tyre S.p.A. or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the Buyer in relation to the same as a result of access to the Site and/or purchase of the P ZERO™ Experience Package or Gift Vouchers.
10.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.
11. Personal data and protection of privacy
11.1. To be able to proceed to process the order and to conclude the contract based on these Conditions, some personal information of the Buyer, of the Additional Driver, of the Companions and of the Voucher’s Beneficiary, as applicable, will be requested through the Site, as indicated in clauses 4.3. and 7. The Buyer acknowledges that the personal data he/she provides for the purpose of the purchase will be collected and used for the purposes indicated in the Seller’s Privacy Policy (7).
11.2. The Buyer hereby declares and guarantees that the data provided during the registration and purchasing process are truthful and accurate.
11.3. For any further information on how the personal data of the Buyer, the Additional Driver, the Voucher’s Beneficiary and the Companions are processed, please refer to the Privacy Policy (8).
12. Security
12.1. Although the Seller has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, the Seller cannot guarantee that the information or data displayed by the Buyer on the Site, even after the Buyer has authenticated access (login), will not be accessible or viewable by unauthorized third parties.
12.2. With regard to credit card and Paypal payments, the Seller adopts technological systems to guarantee the highest levels of reliability, security, protection and confidentiality in the transmission of information via the web.
13. Applicable law, conciliation and jurisdiction
13.1. Each purchasing contract entered into between the Seller and the Buyer pursuant to these Conditions shall be governed by and construed in accordance with Austrian Law and, in particular, for Consumers, in accordance with the Consumer Protection Act (Konsumentenschutzgesetz), the provisions related to consumer contracts, the Act on Distance
13.2. Selling and Sales Off Premises (Fern- und Auswärtsgeschäfte-Gesetz), with specific reference to the provisions related to distance contracts and, also for the Professionals, in accordance with the E-Commerce Act (E-Commerce-Gesetz) regarding some aspects of the electronic commerce. In any case, the rights eventually attributed to the Consumers by mandatory provisions of laws, when applicable, are reserved.
13.3. In case of any disputes arising between the Seller and a Consumer, a friendly conciliation attempt may be promoted by each Consumer before either “Internet Ombudsmann”, an independent and institutional service provided by the Austrian Institute for Applied Telecommunication (Österreichisches Institut für angewandte Telekommunikation), or “Schlichtung für Verbrauchergeschäfte” an independent and institutional service provided by the Association “Arbitration for Consumer Transactions” (Verein “Schlichtung für Verbrauchergeschäfte”) which consents to achieve a satisfactory agreement, with the help of a neutral and competent conciliator, in a friendly and safe manner on the web. For further information concerning the “Internet Ombudsmann” regulation or in order to send a conciliation request, please visit www.ombudsmann.at. For further information concerning the “Schlichtung für Verbrauchergeschäfte” regulation or in order to send a conciliation request, please visit (www.verbraucherschlichtung.at).
13.4. As an alternative to the conciliation attempt referred to in the preceding Clause 13.2, the Consumer, in order to resolve any dispute arising between the latter and the Seller, might also access the European Online Dispute Resolution platform (the European ODR Platform). The European ODR Platform has been developed and is managed by the European Commission, in accordance with Directive no. 2013/11/EU and Regulation EU no. 524/2013, in order to facilitate an independent, impartial, transparent, efficient, rapid and just resolution of out-of-court disputes relating to contractual obligations arising out of online sale or service contracts between a consumer residing in the European Union and a professional established within the EU, through the intervention of an ADR (“Alternative Dispute Resolution”) body, to be selected from a list available thereof. 13.5. In the event that the Consumer or the Seller does not adhere to one of the conciliation attempts referred to in Clauses 13.2 or 13.3 above or such attempt has a negative outcome, the dispute shall be deferred to the jurisdiction of the Court where the Consumer has his or her residence or domicile, or at the choice of the Consumer the Court where the Seller is domiciled.
13.6. In case of disputes arising between the Seller and a Professional, the same shall be deferred to the exclusive jurisdiction of the Courts of Wien.
13.7. This English translation is made only in order to facilitate the understanding of these Conditions. In the event of any discrepancy between the Austrian version and this English translation, the Austrian version shall always prevail.
1. Subject
1.1. These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "PZE Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”). The Buyer from a Third Party and the Voucher’s Beneficiary will be jointly referred to as the “User(s)”. The User will have received an univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).
1.2. Each PZE Package or Gift Voucher will entitle the User, who will be registered by using the Coupon Code through the dedicated web page of the site https://pzeroexperience.pirelli.com/en- gb/free-experience (hereinafter respectively the “Web Page” and the “Site”) to participate, at the Silverstone Circuit (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the Car at the Circuit.
1.3. The PZE Packages and Gift Vouchers are sold by Pirelli UK Tyres Limited, with its registered office at Derby Road, Burton on Trent, DE13 0BH (hereinafter “PIRELLI”). 1.4. Any communication by the User, in connection with and/or in relation to the PZE Package and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeuk@pirelli.com (hereinafter the "Customer Service"). 1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the Site via the internet, including any telephony costs incurred by the User with his/her service provider.
2. The PZE Package features and important rules for the access to the Circuit.
2.1. The PZE Package and the Gift Voucher are provided by PIRELLI with the features described on the Site and in accordance with these Conditions.
2.2. PIRELLI reserves the right to amend the agenda of the Event at any moment in time and as its own discretion.
2.3. The PZE Packages and/or the characteristics of the same, are subject to change without notice and therefore, the Seller does not assume any responsibility in the event of changes in the contents of the PZE Package and/or program variations.
2.4. Access to the Circuit, following the procurement of a PZE Package, will only be allowed to Users: (i) whose vehicle features on the list of Cars published on the Site; and who (ii) hold a valid driving licence entitling them to drive such vehicles.
2.5. Access to the Circuit by each User is subject to:
(i) the unconditional acceptance and agreement by the User of the indemnity documents that the Seller and the car manufacturers will ask the User to sign, which can be seen here
(ii) the acceptance and agreement to the PZE regulations (which incorporate any Circuit regulations, which can be seen here.
2.6. Access to the Circuit will not be allowed to people other than the Users, their registered Companions (if any), nor to cars other than the Cars and always in compliance with the PZE Regulations.
3. PZE Package and Gift Voucher registration procedure
3.1. Before proceeding with the registration using the Coupon Code, the User must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the list of Cars for compatibility with their vehicle and the documents referenced under section 2.3 from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.
3.2 On the Web Page, the User will be invited to provide his/her personal data and the details of the Car he/she will drive during the Event, as well as personal data of the Companion(s) if any, in order to complete the registration process for the attendance to the Event.
3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address each User provided to PIRELLI, during the registration process, of an email confirming that the registration has been successfully completed, which will contain a link to the text of these Conditions, the name of the natural person who is registered to use PZE Package or the Gift Voucher (both coinciding with the User), the names of the Companion(s) (if any), the day of the Event, the model and licence plate of the Car authorised to access the track and a description of the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and the User may request copies by sending an email to Customer Service.
3.4 The User cannot be changed after receipt of the Access Pass.
4. Delivery and use of the PZE Package and/or of the Gift Voucher
4.1. To be able to use the PZE Package or the Gift Voucher, as applicable, the User must show the Access Pass at the entry to the Circuit on the day of the Event, and comply with the provisions of clause 2.4 above.
4.3. If the User is absent on the day of the Event, the right to use the PZE Package or the Gift Voucher will be lost, without possibility of reimbursement.
5. Cancellation Communications
5.1. In the event that the User wishes to cancel his/her participation in the Event, the User must send an e-mail to Customer Service. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by the entity who sold the PZE Package to the Buyer from a Third Party.
6. Intellectual Property Rights
6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site/Web Page or relating to PZE Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the User in relation to the same as a result of access to the Site/Web Page and/or purchase of the PZE Packages or Gift Vouchers.
6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.
7. Personal data and protection of privacy
7.1. To be able to proceed with the registration process of the User and any Companion(s), for the purpose of participating in the Event and based on these Conditions, some personal information of the User, of the Companions (if any), will be requested through the Web Page, as indicated in Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the registration process for the Event will be collected and used for the purposes indicated in the PIRELLI Privacy Policy.
7.2. The User hereby declares and guarantees that the data provided during the registration process are correct and true.
7.3. For any other information relating to the processing of the personal data of the User, the Companions (if any), please refer to the PIRELLI Privacy Policy.
8. Security
8.1. Although PIRELLI has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the information or data displayed by the User on the Site and/or the Web Page, will not be accessible or viewable by unauthorized third parties.
9. Applicable law and jurisdiction
9.1 These Conditions shall be governed by and construed in accordance with laws of England and Wales.
9.2 In case of any disputes arising between PIRELLI and the User the same shall be deferred to the exclusive jurisdiction of the Courts of England and Wales.
1. Subject
1.1. These general terms and conditions (hereinafter the “Conditions”) shall apply to any natural person who (i) purchased a package named P ZERO™ Experience (hereinafter the "P ZERO™ Experience Package") from an entity other than PIRELLI (hereinafter the “Buyer from a Third Party”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”), or (iii) has been indicated as Additional Driver, or (iv) has been indicated as substitute driver in the framework of the sale of a P ZERO Experience Package (hereinafter the “Substitute Driver”). The Buyer from a Third Party, the Voucher’s Beneficiary, the Additional Driver and the Substitute Driver will be jointly referred to as the “User(s)”. The User will receive a univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).
1.2. Each User must use the Coupon Code on the dedicated web page of the site free experience (pirelli.com) (hereinafter respectively the “Web Page” and the “Site”) in order to participate, at the Mugello Circuit (hereinafter the "Circuit") to a day on track with his/her own car (the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the Car at the Circuit.
1.3. The Event is organized by Pirelli Tyre S.p.A, a joint stock company with a sole shareholder - management and coordination of Pirelli & C. S.p.A., with registered office in Viale Piero e Alberto Pirelli, 25 – 20126 Milan (Italy), Tax Code, VAT No. and Milan, Monza Brianza and Lodi Business Registry Enrolment No. 07211330159, R.E.A of Milan 1147607 (hereinafter “PIRELLI”).
1.4. Any communication by the User, in connection with and/or in relation to the P ZERO™ Experience Package and/or to the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeroexperienceitalia@pirelli.com (hereinafter the "Customer Service").
1.5. The User shall be responsible for any costs incurred to connect to the Web Page and/or the Site via the internet, including any telephony costs incurred by the User with his/her service provider.
2. The P ZEROTM Experience Package and Gift Voucher features and important rules for the access to the Circuit.
2.1. The P ZEROTM Experiences Package and the Gift Voucher are provided by PIRELLI with the features described on the Site and in accordance with these Conditions.
2.2. The possibility of accessing the Circuit will be allowed only to Users who:
(i) have completed the registration procedure on the Web Page using the Coupon Code, indicating any companions (the “Companions”) where applicable;
(ii) are legitimate owners/keepers of the Car(s);
(iii) are 21 of age or over and have a driving license in the course of validity, issued for at least 36 (thirty six) months and not subject to suspension or other sanctioning measures;
(iv) have y accepted and agreed to the Circuit regulations
(v) have accepted and agreed to the P ZERO™ Experience regulations which will be provided by PIRELLI and which can be read and downloaded here;
(vi) have accepted and agreed to the indemnity documents that the Circuit and PIRELLI will ask them to sign. Click here to read and download the indemnity documents of the Circuit and of PIRELLI.
2.3. The access to the Circuit will not be allowed to people other than the Users (once registered) and their registered Companions (if any) nor to cars other than the Cars and always in compliance with the P ZERO™ Experience Regulations. No other person out of the User will be permitted to drive the Car
3. P ZERO™ Experience Package and Gift Voucher registration procedure
3.1. Before proceeding with the registration using the Coupon Code, the User must carefully read and fully accept (and print and/or save copies for his/her records of) the Conditions, as well as the list of Cars and the documents referenced under section 2.3 from (iv) to (vi) by checking the appropriate boxes (check-box) on the Web Page.
3.2 On the Web Page, the User will be invited to provide his/her personal data and the details of the Car he/she will drive during the Event, as well as personal data of the Companions if any , in order to complete the registration process for the attendance to the Event.
3.3. The User’s registration is accepted by PIRELLI with the dispatch to them, at the email address each User provided to PIRELLI, during the registration process, of an email confirming that the registration has been successfully completed, which will contain a link to the text of these Conditions, the name of the natural person who owns the P ZERO™ Experience Package or the Gift Voucher, the name of the Substitute Driver, the names of the Companions (if any) , the day of the Event, the model and licence plate of the Car authorised to access the track and a description of the Event ("Access Pass"). The Access Pass, and the Conditions applicable to the relationship between the User and PIRELLI, will be archived electronically by PIRELLI in its IT systems, and the User may request copies by sending an email to Customer Service.
3.4 The Buyer from a Third Party and the Voucher’s Beneficiary’s names can be changed after the receipt of the Access Pass, only once and for serious and documented reasons (such as, by way of example, illnesses and injuries) to be communicated by the User at least 2 (two) days before the Event. In this case, the person indicated as Substitute Driver must, as a condition for participating in the Event, accept and sign these Conditions.
4. Delivery and use of the P ZEROTM Experience Package and/or of the Gift Voucher
4.1. To be able to use the P ZERO™ Experience Package or the Gift Voucher, as applicable, the User must show the Access Pass at the entry to the Circuit on the day of the Event and comply with the provisions of clause 2.2 above.
4.3. If the User is absent on the day of the Event, the right to use the P ZEROTM Experience Package or the Gift Voucher will be lost.
5. Cancellation Communications
5.1. In the event that the User wishes to cancel his/her participation in the Event, the User has to send an e-mail to the Customer Service. Any refund, if applicable (depending on the timing of the cancellation communication) will be made by PIRELLI to the purchaser of the Gift Voucher or by the entity who has sold the P ZERO™ Experience Package to the Buyer from a Third Party.
6. Intellectual Property Rights
6.1. The User acknowledges that he or she is aware that all trademarks, names and other distinctive signs, including - without limitation - the “PIRELLI” letters and logo trademark, the “P ZERO™” trademark as well as any images, photographs, written text or graphics used on the Site/Web Page or relating to P ZERO™ Experience Packages and Gift Vouchers are and remain the exclusive property of Pirelli & C. S.p.A., PIRELLI or their respective owners, as the case may be (jointly and severally, the “Owners”), with no rights arising on the part of the User in relation to the same as a result of access to the Site/Web Page and/or purchase of the P ZERO™ Experience Package or Gift Voucher.
6.2. Unless prior specific consent is granted in writing by the Owners, no contents of the Site/Web Page can be wholly or partially reproduced, transferred using electronic or conventional means, modified or used for whatever purpose.
7. Personal data and protection of privacy
7.1. To be able to proceed with the registration process of the User, Companionsif any and as applicable, for the purpose of participating in the Event and based on these Conditions, some personal information of the User and of the Companions , will be requested through the Web Page, as indicated in Clause 3.2. The User acknowledges that the personal data he/she provides for the purpose of the registration process for the Event will be collected and used for the purposes indicated in the PIRELLI Privacy Policy.
7.2. The User hereby declares and guarantees that the data provided during the registration process are correct and true.
7.3. For any other information relating to the processing of the personal data of the User and of the Companions (if any), please refer to the PIRELLI Privacy Policy.
8. Security
8.1. Although PIRELLI has adopted measures to protect personal data against any loss, falsification, handling, and misuse by third parties, given the technical features and limitations on the protection of electronic communications over the Internet, PIRELLI cannot guarantee that the information or data displayed by the User on the Site and/or the Web Page, will not be accessible or viewable by unauthorized third parties.
9. Applicable law, conciliation and jurisdiction
9.1 These Conditions shall be governed by and construed in accordance with Italian Law and, in particular, for consumers (“Consumer(s)”: means any natural person who is acting for purposes which are outside his trade, business, craft or profession), in accordance with Italian Legislative Decree 6 September 2005 no. 2016 (the Italian Consumer Code), with specific reference to the provisions related to distance contracts. In any case, the rights eventually attributed to the Consumers by mandatory provisions of laws, when applicable, are reserved.
9.2 In case of any disputes arising between PIRELLI and a Consumer, PIRELLI guarantees its participations to a friendly conciliation attempt which each Consumer may promote before “RisolviOnline”, an independent and institutional service provided by the Chamber of Arbitration of the Milan Chamber of Commerce, which consents to achieve a satisfactory agreement, with the help of a neutral and competent conciliator, in a friendly and safe manner on the web. For further information concerning the “RisolviOnline” regulation or in order to send a conciliation request, please visit www.risolvionline.com.
9.3 As an alternative to the conciliation attempt referred to in the preceding Section 9.2, the Consumer, in order to resolve any dispute arising between the latter and PIRELLI, might also access the European Online Dispute Resolution platform (the European ODR Platform). The European ODR Platform has been developed and is managed by the European Commission, in accordance with Directive no. 2013/11/EU and Regulation EU no. 524/2013, in order to facilitate an independent, impartial, transparent, efficient, rapid and just resolution of out-of-court disputes relating to contractual obligations arising out of online sale or service contracts between a consumer residing in the European Union and a professional established within the EU, through the intervention of an ADR (“Alternative Dispute Resolution”) body, to be selected from a list available thereof. 9.4 In the event that the Consumer or PIRELLI does not adhere to one of the conciliation attempts referred to in clauses 9.2 or 9.3 above or such attempt has a negative outcome, the dispute shall be deferred to the jurisdiction of the Court where the Consumer has his or her residence or domicile.
9.5 This English translation is made only in order to facilitate the understanding of these Conditions. In the event of any discrepancy between the Italian version and this English translation, the Italian version shall always prevail.
1. Subject
1.1. These general terms and conditions (hereinafter the “Conditions”) shall apply to users (hereinafter the "User“) who purchased a package named P ZERO™ Experience, (hereinafter the "P ZEROTM Experience Package") from an entity other than Pirelli (hereinafter the “Third Party Entity”) or (ii) received a gift voucher (hereinafter the “Gift Voucher” and a “Voucher’s Beneficiary”), or (iii) has been indicated as additional driver (hereinafter the “Additional Driver”) or (iv) has been indicated as substitute driver in the framework of the sale of a P ZERO™ Experience Package (hereinafter the “Substitute Driver”). The Buyer from a Third Party, the Voucher’s Beneficiary, the Additional Driver and the Substitute Driver will be jointly referred to as the “User(s)”. The User will receive a univocal code (hereinafter the "Coupon Code") for his/her registration, necessary to participate in the Event (as defined in Section 1.2 below).
1.2. Each User must use the Coupon Code on the dedicated web page of the site https://pzeroexperience.pirelli.com/en-at/ (hereinafter respectively the "Web Page” and the “Site”) in order to participate, at the Red Bull Ring Circuit (hereinafter the “Circuit") to a day on track (hereinafter the “Event”), subject to such car being on the list of approved vehicles published on the Site (“Car(s)”). The User must be the driver of the car at the Circuit.
1.3. The Event is organized by Pirelli GesmbH, with registered office Lemböckgasse 47 A, 1230 Wien, Austria, Vat No: ATU14205803 (hereinafter "PIRELLI").
1.4. Any communication by the User, in connection with and/or in relation to the P ZERO™ Experience Package and/or the Gift Voucher (as applicable), including during the registration process of the Coupon Code shall be made to the addresses and in accordance with the modalities indicated on the Site or to the email address pzeroexperience.centraleurope@pirelli.com (hereinafter the "Customer Service").

2.3. 8. Security
8.1. 9. Applicable law, conciliation and jurisdiction.
9.1. These Conditions shall be governed, construed and interpreted in accordance with Austrian Law and, in particular for consumers (“Consumer(s)” means any natural person who is acting for purposes which are outside his/her trade, business, craft or profession) in accordance with the Consumer Protection Act (Konsumentenschutzgesetz), the provisions related to Consumer contracts, the Act on Distance. In any case, the rights eventually attributed to the Consumers by mandatory provisions of laws, when applicable, are reserved.
9.2. In case of any disputes arising between PIRELLI and a Consumer, a friendly conciliation attempt may be promoted by each Consumer before either “Internet Ombudsmann”, an independent and institutional service provided by the Austrian Institute for Applied Telecommunication (Österreichisches Institut für angewandte Telekommunikation), or “Schlichtung für Verbrauchergeschäfte” an independent and institutional service provided by the Association “Arbitration for Consumer Transactions” (Verein “Schlichtung für Verbrauchergeschäfte”) which consents to achieve a satisfactory agreement, with the help of a neutral and competent conciliator, in a friendly and safe manner on the web. 9.3. In the event that the Consumer or PIRELLI does not adhere to one of the conciliation attempts referred to in Clauses 9.2 or 9.3 above or such attempt has a negative outcome, the dispute shall be deferred to the jurisdiction of the Court where the Consumer has his or her residence or domicile, or at the choice of the Consumer, the Court where PIRELLI is domiciled.
9.5. This English translation is made only in order to facilitate the understanding of this Conditions. In the event of any discrepancy between the Austrian version and this English translation, the Austrian version shall always prevail.
